frankly every isp think it don't applies to them. left mweb at the end of february. for openweb and a "wonderful" gold account.

even openweb. i've cancelled with them before i even had a username but i still had to give a months notice. so now i'm using the product as i've paid for it.

but i'm finished with isp's and their one months notice. no more. no more noitce. no more debit orders. no more abuse from isp's.

If I may ask... Why did you cancel? and how is your internet experience with the openweb connection? and what are you planning to use for internet once you are finished with isp`s? The reason I ask is because I`m on telkom uncapped and looking at the my options.

I am leaving Mweb and the plan was to go to OpenWeb, so I am also interested to hear the story.

The best bet is to simply refuse to comply with a 1 month notice period. I have told Mweb that I will not filling in any form or jump through any hoops to cancel, and that they can shove their notice period, I do not care what they have written down on some paper. What are they going to do? Try sue you for 1 month's fee? No court in this country will tolerate a claim of a few hundred Rand.

Cancellation Fees + Lawyers’ Fees + On-going Admin Fees + Penalties + Interest = Adds Up and blacklisting
 
@nazz & CapetonianMike. my 1mb line ran at about 10kbps (95kbps) slower than my line did at mweb (105kbps). on a gold package. but my 2mb line is about 20kbps (200kbps) slower than mweb (220kbps).

there's nothing wrong with my line or anything. its just slower.

i test it against my cybersmart and webafrica accounts and for some reason its slower.

nothing changed except that i changed from mweb to openweb.

Lawyers fees can not be enforced without a court order, and I will have any blacklisting without a court order reversed.

Big company use these threats like these to scare the little people. I have been threatened with law suites about a dozen times now, it is all just a case of intimidation. I have also initiated legal actions, and simply getting a court date on a hearing takes a lot of effort and money, at levels where claims of less that 10k or maybe 15k are just cheaper to write off.

Mweb can get their lawyers to contact me, I love chatting with lawyers :D

Or maybe I am not the idiot for knowing the law. Read up on the Consumer Protection Act, and you will realise that when big companies try threaten people it is often in contradiction of the law. Don't call people idiots when they stand up for their rights.

Technically I think there is really much to be desired about their uncapped offering and the way they present it. If challenged it may not even be lawfull.

So they say, come on folks.. It's uncapped. Download all you want.

Oh, wait a minute.. We're kicking you off because you downloaded to much. They don't give any figures or anything concrete. People have to blindly guees how far they can go.

Sounds a lot like the kind of tactics a school bully would employ.

Their offering is a contradiction in itself.

I think this is more CPA. I received an abuse notification from Mweb and then argues that this being an uncapped product and understanding fair use, the company can not issue a warning without assisting you to resolve the concern. My MWeb performance (with the exception of Seacom for almost 2 weeks) has been good and as such, I am eagerly awaiting subsequent abuse notifications to test how far this can go. I do think CPA needs to be tested in this regard and I see MWeb (or any other ISPs) fair-use-policy no different than:

- You hire a car with unlimited mileage and then get told by the car-rental company that you are abusing it, but they do not tell you if you should only drive 100km/h or that you are only allowed to drive 500km/day
- You have a gym contract and the gym tells you that you are abusing the facility - they do not tell you if you are going there to often or if you are using too many of the exercise machines

I am not sure if other ISPs send out similar notifications and how they deal with it. Despite what MWeb says, I do believe that abuse notifications are purely based on download volume and maxing out the line is not the issue (I got into trouble for downloading 24x7 at 150KB/sec). To me it seems that MWeb's abuse notifications trickle in for anyone downloading over 350GB/pm.

In recent months it has been difficult to download even 100Gb a month for two reasons.

1) In the evenings and on weekends, the exchange is so bloody congested I have to wait until 11-12 at night to get anything done
2) I am not risking leaving my ADSL connected 24/7 again. It cost me dearly, the weather came up while at work, and the lightning destroyed my desktop PC and several items in the house
