You blame the criminal. You must have a pretty ****ed up perception of crime if you ever blame someone for their own stuff being stolen instead of blaming the person doing the stealing.

Sadly, a lifetime of dealing with crime has instilled a mindset of victim blaming on South Africans.

The difference is of course is if this owner is paying by the GB. Then he may be paying more because of this user.
That's obvious stealing. The quality i.e. speed of his connection may be degraded because of the extra use.

Copyright infringement is not the same though. Hacking into iTunes and downloading from them, using their b/w or stealing a DVD from a shop would be stealing. Copyright infringement is a different issue. But how far does it extend? If you reveal the spoiler of a movie to a friend, are you also not then stealing or infringing on copyright? Our whole culture is built on copying. In the past no folk song or folk tale or recipe was copyrighted. That emerged later. It's also not unheard of to invite people to watch a sports match or a video in your home. People also lend CDs, DVDs, whole computers to others. It was also not unheard of in the past for people to record TV shows for others on video tape. The digital extension of the internet just made this more pervasive.

The other issue is trespass. That is hacking into someone else' router even if they only have a default password.

How do you deal with requests from relevant authorities about users committing illegal downloads (we are not talking about pirating stuff)?

I think he means a user who illegally downloads some ISIS bomb making materials or child porn. The authorities will come after you. And then the onus is on you to prove you did not download it. Meanwhile the whole world will know you are a child pornographer, until the cops get to the truth, if at all, and then some paper prints some backpage apology nobody will ever read.

Bottom line is there is nothing on your pc and your WiFi is open. Any real cops who go after you will see that and use your setup to catch the guy. Also... You can still put everything through your own firewall just to be on the safe side

Good luck getting your PC back in one piece after the investigation. (There was a story about home equipment confiscation, where not all parts came back)

Debatable, but still T&C state that one is responsible for securing their wi-fi and anything happening on it.

Firewall cannot block those kinds of websites, especially if they are unpopular/underground/obscure/w.e.

Do you honestly think that in South Africa a policeman is going to go through your PC and check your setup ? You would more likely be part of a search and seizure operation which will be executed immediately (by seizing all equipment for later examination) and then questions would be asked later with possible arrest or detention. Whether you are guilty or not is irrelevant at that stage as they will have probable cause based on whatever evidence they have linked to your IP address. So best case scenario is that you hire some high powered lawyer that will try get you release on bail, argue for the return of your equipment and/or have the case thrown out - either way its money, time and possible publication of your alleged deeds. This all when the majority of the legal system struggles to use Facebook and you expect them to understand that your wifi network was open and it wasn't you.

There are plenty of examples worldwide of people who have been arrested, raided, detained etc because someone hijacked their wifi - is it really worth it?
