Had this proposed bill been in effect, the police would have had no option but to arrest him.

They simply want to make it a criminal offense so nobody is given any new protection apart from the new categories of "hate" speech. Then the existing legislation already has room for hate crimes but it's just never been applied.

Yes, you are right. I was incorrect when I said there are no laws specifically about hate speech, what I meant (as I clarified later) was no laws criminalizing hate speech. The existing laws are civil - someone has to take the accused person to court and can get monetary compensation, just like any civil court case. If nobody takes the individual to court, nothing happens. When hate speech is criminalized, the police have to arrest the accused person as they have committed a crime - irrespective of whether an individual is suing them in civil court or not...

I wouldn't call it backtracking, no, I would call it learning. I said in my very first post on this matter that my opinion was one of a layman and I don't see a problem with accepting that there are words that may require further clarification, once it's pointed out to me. I didn't realise that one is supposed to pick a point of view and stick to it come hell or high water or be be accused of 'backtracking'. My fundamental view has not changed. This bill is good and long overdue - yes, some terms may require further clarification before it's implemented but the basic reasoning behind it is good, IMO

Probably no use arguing. If you cannot see how this government is continuously trying to sign new petty proposals into law (the internet bill is another example) which can ultimately be used as a tool to protect themselves well then so be it. My comment was specifically aimed at Mila who was quite vocal about calling for Malema to be arrested for hate speech.

BEE does not protect people at the lower end of the scale. It protect blacks at the higher end of the scale.

Nobody is crying for tougher laws. Lack of enforcement of existing laws is where people get their knickers in a twist. Making new laws is 100% pointless when the basics are out of reach.

I think the problem is that most people see it as another law which sounds all fine on the surface but which will be used / applied unevenly. I don't think anyone (barring a few) sees anything wrong with restricting real hate speech. Law which is written, and will be used to silence opposition to the government (or individuals within it) and applied heavily against Whites, while allowing Blacks to get away with a slap on the wrist (if they are even prosecuted) is naturally going to be objected to.

I just object to more laws. In most instances the problem is not lack of laws, but lack of application of the law. Most situations are resolved with proper effective policing and fair and proper application of the law that exists already. Only in a few exceptions is there a possibility for a new law to be drafted.

It solves nothing to make yet another law that will be applied as unevenly and badly as the existing laws.


FYI - I see you failed to respond to my previous post to you. Let me recap for you, because I truly mean it. If you object so unbearably much to anything to do with Whites, please go find yourself a piece of land, take off all your clothes, watch, cellphone, car, and all other trappings of White colonialist power you hate so much, and live in a traditional hut, with traditional cattle, and mielies to eat, with only the medical help that can be given by a sangoma. BEE is supposed to enrich the previously disadvantage, it has failed, stifles the economy as well as starves them of talent as more then often it has to make do with what is inline with BEE, all it's doing now is enriching the already enriched, and far too many BEE goverment sanctioned projects falling flat on their faces due to incompetent management and general lack of skills and after support.

Name at least one successful government sanctioned BEE project that is still in operation since the inception of the act, you are going to have a hard time finding one, in the sea of 4.5million of search results of BEE having failed. There probably is a few out there, but I bet you aren't going to need more then two hands to name them.

Unless you can provide proof that in general BEE is really helping those seriously disadvantage across South Africa, I reserve my right to be as hypocritical.
