Offer to purchase question

Actually, I don't think any poster wrote "mail" in this thread previously. I'm not a legal expert, but my guess would be an equivalent message over either Whatsapp or email would have the same legal status. Emails, in general, do tend to be more thorough with Whatsapp generally just a few words or short sentences.
Oh, yes, e-mail is mentioned in posts 2, 36, 39 and 49, and in post 58 a distinction is drawn between the value of mail and Whatsapp. That's why I asked.

Please, would one of the lawyers confirm: Is e-mail regarded as sufficient, as having put things in writing? Or does it have to be paper, presumably delivered to the designated premises before the deadline?

#58 only mentions email. I don't see anything about mail there?
 
UPDATE:

Just received a mail from agent which was a direct reply to my withdrawal of original offer.

She says the Whatsapp messages from the sellers confirming they accept the higher amount is enough evidence/confirmation of offer.

Then she follows up by saying she is going to forward us Page 3 of the original OTP to fully sign again next to OUR amended amount. And in her words... "Then that will make the deal final and the sellers cannot change their minds again." Erm... not exactly OUR offer, but okay.
She wants us to fully sign, scan and return the document to her immediately. She says, and I quote.... "Then I will take it to the sellers tomorrow to sign the counter offer"

In the next mail she attaches the amended page 3 of the original OTP with the amended amount.
She again says we must both sign fully next to the changes and then says: "THIS COUNTER OFFER WAS IN PLACE SINCE 18H00 LAST NIGHT"

On the attached document the original purchase price is scratched out and changed to the higher amount, as well as the amount we will be applying for for a bond.
Only her full signature is next to both amendments.

Again asking for us to immediately sign and send it back to her.
 
Not a lawyer and don't have experience like the posters above but looks like the agent is taking a chance?

Tell her you appreciate her efforts but you've decided to look for another place.

Standard bollocks... Trying her luck... Desperate because she is losing out on the commission.
 
Lol, it's not signed, ignore. Original contract is the only one valid. Check for a clause as well but to my knowledge once a contract is in writing, it can't be altered without dual signatures again. Most contracts will state changes must be in writing.

Will do. It is eerily quiet from her side since I sent the mail.

She has been sending messages and voicenotes till late last night and also early this morning urging us to sign it and get it back to her so that she can then go and get the sellers' signature on it.

Just signed OTP this morning, hopefully offers gets accepted and everything works out my side. Agent has been really good, he told me straight, offers these people less they will probably accept it.
 
I find these agents that think they can bully people into spending literally millions rather pathetic.

One of the things I will be doing going forward if I sign any Offers to Purchase in future, is adding a small addition to that clause of something along the lines "At an acceptable interest rate to the buyer" ... just leaves the door open to bail out at the last minute...

Just signed OTP this morning, hopefully offers gets accepted and everything works out my side. Agent has been really good, he told me straight, offers these people less they will probably accept it.

Yeah not proud of the mistakes we made and the tricks we fell for.

She was also super nice and she was the one that told us we should offer that much lower price. Then she started pushing us for a signed OTP because there was suddenly another prospective buyer that was on the verge of sending her an OTP. And she and the seller (wife side) really wanted us to get the property.

In hindsight it is the oldest trick in the book and we fell for it. Should have let the other interested party sign, if they really even existed, and take our time making the decision.

The insidious "other buyer", it magically makes reason and thoughtful consideration go flying out the window if you aren't careful

If she phones you - tell her fortunately she has another buyer lined up, ready to sign :D
