Okay come back again after your CPA case went nowhere and tell me how that worked out for you.

By the very nature of this thread you aren't even making use of the CPA and trying to find an alternative solution... I wonder why that is.

The only thing that you can reasonably expect from the dealer in this case is to more adequately repair the vehicle, but even that is a long shot as the supposed "problem" doesn't seem to be a problem at all.

You still haven't explained how you took ownership of this vehicle and were quite happy with it's state until you changed you mind two weeks later.

CPA says either the dealer must repair the defects or refund the buyer... hence I'm saying go read it again and this time read it to understand, don't just read it. I've already made use of CPA...
 
You are a very special snowflake to have such deep feelings about a car that reminds you of being deceived...which is yet to be proven.

The car wasn't necessarily in an accident. Or the salesperson genuinely wasn't aware of it.

Get over yourself.

So you were there? Where you there? Have you seen the car? Did you speak to he salesperson afterwards? If you can answer any of these questions then you will get your golden star...
 
Did you read the part that says that a car dealership that sells second hand cars are suppose to disclose any defects to the buyer before the sale is done.. And if the buyer agrees and later wants to return they have no foot to stand on because they were made aware of the defects. So DEFECT means it was in an accident which wasn't disclosed... how in the hell are they suppose to fix that? I didn't change my mind sweetheart. The truth always comes out

Also you'd need to prove their knew about the supposed defect. Then prove that it is actually a defect that affects the quality of the vehicle.

Since this isn't a new car there are a great many "defects" that will be considered reasonable wear and tear.

Also as I've advised previosly a defect doesn't equal an accident.

I strongly advise that you being the person who has no prior experience with cars or dealerships stop trying to tell other people who have been throught this countless times that they don't know what they are talking about.

You are the one who doesn't know what you are talking about. You've never done this before and you are reading little bits and bobs you found on the Internet and think you can run around and demand refunds and sue everyone.

That simply isn't reality.

Take a step back and consider how unreasonable you've been about the issue at hand and then to the people involved with it and ask yourself why nobody seems willing to help you.

You need to change your approach to dealing with such problems otherwise you are in for a very hard time.

Yeah you are glancing past all the important bits regarding the defect being legitimate, reasonable and provable as well as the parts about wear and tear.

Those are the exact sections that will have you getting stuck.

More so because this isn't a new car.

What I meant with there is no such section is that there is no such section which reads the way you read it.

You are conveniently skipping over all the caveats and intricacies that protects the dealer thinking that you can just demand a refund and it will he taken seriously.

Your very first hurdle is to prove that your defect is in fact that and not wear and tear.

Then you need to prove that they knew about it and didn't disclose it. Then you need to prove that your demands are reasonable etc.

Again anyone would ask if the problem was so unreasonable why did you take the car and that is where it gets rocky very quickly.

Also I can comment as much as I like.

OP, have you heard of Wendy Knowler, contact her and check if she can investigate this dealership and let her help you.
 
The end result is most likely either you keeping the car or selling at the R50k you were offered.

For peace of mind maybe take the car for one of those detailed AA tests. At least then you will have an idea of the extent of the accident. Should be able to see if the car had been on a jig for chassis straightening, or it was merely a bumper bash that was repaired in a backyard.

Your attitude is not going to get you any constructive help so maybe calm down a bit.

The dealer is unscrupulous, so it's unlikely they are going to make this process easy for you.

It would cost R900 to fix the damage, yet this damage affects the value of the vehicle by R25k? I've paid that to have some minor scratches fixed, so it doesn't add up. What is actually wrong with the vehicle?

OP can't afford to lose the money but doesn't have insurance...:wtf:

God be with you so it means every time you are involved in an accident you are going to sell the car.

if the dealership agrees to the refund, that's a start, if two months is too long then simply give them a letter of demand and follow the process, it shouldn't be that difficult

if they refuse to refund that would have been a different story
 
Look. You marked them as dodgy.. ok... I wanted to see for myself... unfortunately we not the same person and we don't think alike. Yes I made a mistake but I also got deceived as well. Therefore I don't want this car cause it's just a reminder of that... It's just better to get rid of it and start over. I already emailed the ombudsmen and speak out... I did most things people suggested however I can't let that car sit there for months while I wait and I refuse to drive it knowing what I know. I'd rather walk it take a taxi

It's only been two weeks and I haven't taken insurance. Once I get a new car I will. I don't wanna pay for something I hate.. please understand

If you have R75k to burn don't insure your vehicle, nevermind the R500k Audi you crash into and with no 3rd party cover the R500k liability is instantly transferred to your name.
Yep that's not what you call intelligence.

If webuycars offers R50k then it's guaranteed to be worth R60-70k. Also considering the lawyers costs it would be clever to take the R50k and be done with the deal now and save all the bs to come if you try sue the seller.

The op seems pretty neurotic, can't give us any idea on the extent of the poorly repaired damage other than R900 will fix it..... Yes the accident was extensive and poorly repaired but I genuinely believe the park and sell guys can fix it for R900 :crylaugh:

Zarley get a good bottle of wine, drink it, have a good cry about it all and then the next day whilst nursing the hangover get insurance first thing in the morning and then take the vehicle to Dekra and have it fully checked out and take it from there.

If Dekra says it's not worth repairing or it's too far gone then take it to webuycars and exit left with your R20k life lesson. Next step move on and use the R50k for a deposit on a vehicle bought from a reputable dealer, the end.
 
OP you're either very immature or naive, not from your responses but by your choices and actions. What happens if you live in a complex and someone writes off your vehicle? What happens if people break in and steal your car? Having no insurance for a car, No matter how the car makes you feel, is just dumb.

Every car owner or potential car owner knows or should know how important insurance is, especially living in South Africa with so many deathtraps/idiots on our roads.


Also what Sauron is saying is correct the CPA is in place for fair trading practices not for one to get ones way. If you do have evidence to prove they knew of the defect beforehand then it'll go smoothly.

On the other hand they themselves can say the person they bought it off of gave them a fake certificate saying everything is fine with the car and they knew nothing.

No wear and tear doesn't mean you damaged the car. Wear and tear means its simply damage expected through prolonged usage.

You are yet to show us pictures and you need to prove there was an accident that lead to this defect.

Unless you become more forthcoming nobody can help you.
 
How do we even know that this car actually exists when we actually haven’t seen any pictures of it? What if we have been dealing with a forum
