Retaining Your SA Citizenship

Hi All

I want to know, if you loose your SA citizenship by becoming a dual citizen, you will automatically become a permanent resident.

Will that give you the right to continue working in SA?

Home Affairs did pass a "law" stating you need to apply for retention of SA citizenship if you get a foreign one however the minute they attempt to charge someone for breaking it they'll be bitch slapped by the ConCourt.

Before you acquire a new citizenship from another country, you need to apply to Home Affairs to retain your South African citizenship.

Well, thats not true. You will lose your citizenship and will face a lengthy and very expensive legal battle to get it reinstated by the ConCourt

Before you acquire a new citizenship from another country, you need to apply to Home Affairs to retain your South African citizenship.

You then get a letter confirming that you may travel on the other passport outside South Africa.

Nope, that's not true either. You will lose your citizenship and then fill in an application to get it reinstated. It's not difficult or complicated however you do have to prove you are still (or back) living in SA. If you're no longer living here it may be more difficult.

Before I applied for my other passport, went to the DoHA and filled out a form and got a letter stating that they give me permission to be a dual citizen and that I will not lose my South African Citizenship once I obtain my second citizenship.

The irony was that the DoHA was not even sure how or what they needed to put in the letter. When I "eventually" got the letter they gave it to me and asked "is this what you need?" I kind of was stunned and just told them that I didn't know since it was their laws I was just following.
 
Generally they won't know or care anyway. So long as you have your ID book (card) and passport you're a citizen and even applying for a new passport in South Africa won't be a problem. It's only a real issue if you need to renew your passport outside of the country as they then become aware that you have a second passport and can check if you were granted retention of citizenship.

When you acquire a new citizenship, the other country requires you to show a letter from Home Affairs confirming that you may retain your South African citizenship.

Maybe some countries do, that wasn't the case for me though. I only found out about 'losing my SA citizenship' long after I got my EU passport and I've had no problem renewing my SA passport since then.

So to be honest, I did this, I filled out that form 2 months ago.

Called home affairs, and they don't know what they did with the application. They have no record of it and I have my slip to prove I paid and applied.

Our was done as children and even when I did my kids, there was no need. I know about the whole letter but that is normally I think only requested when applying for a passport.

Travelled quite a few times on both passports, out and in SA with the SA one and anywhere else with the other if you chose. I think it may be different if you were living abroad and had the issue yes.

It is required when applying for EU (or other) citizenship

I don't see that it makes any difference to a foreign government whether or not you choose to keep your SA citizenship.
I was never asked for a letter or anything confirming my application to keep my SA citizenship (I've renewed my EU passport once since initially applying for it).

You might not see why, but nevertheless, it is a document you need to provide.
I had to provide it for EU citizenship.

Remember the process might have changed since you obtained a new citizenship...
