I'm pretty sure you can't get a refund on section 6 rebates.

Aren't the rebates limited to zero, i.e. if not used they'll just fall away.

You don't understand tax, your deductions (RA's) and rebates (Medical Aid) only reduce the amount you pay in tax up to the amount of Rnil. You can only ever receive a refund on what you have Actually paid, on PAYE and/or Provisional tax. You will NEVER receive more money than you originally paid in.

Have you considered the possibility that you don't know how they work?

I do understand a lot of it, I didn't know this one part. So I was wrong. Will you sleep better now?

You don't understand how tax returns work, then. They're giving you back tax on other things that you paid tax on through the year, i.e. medical aid (as in my example), RA's etc.


As a a Tax Practitioner, I can assure you that you can only get a refund based on the tax that you paid during the year. If your total tax (PAYE, Provisional Tax) paid is R3 000, the maximum refund you can get would be R3 000.00. Irrespective of RA or Medical Aid rebates.

Do you know what the logic is behind receiving R286 per member for the first 2 dependents on medical aid, no matter how much your medical aid contribution? I've always found it curious that it's a fixed amount.

No, but a whole bunch of people reading this thread won't be terribly misinformed. Also, no need to get personal about this - you start offinsulting me and then increase the insults when you're shown to be incorrect. A little humility goes a long way.

Indeed. If there are any unclaimable (aka unused) RA tax benefits they will just be carried forward till next year. Medical Aid rebates are use it or lose it and will not carry over.

It is to make it fair towards lower income earners. In the past one used to be able to deduct the full amount of your medical aid off taxable income, but that provided a far greater relief to higher earners than lower earners. The fixed rate tax credit removes this imbalance so that everyone gets the same relief, irrespective of income.

If you earn less than R1million p/y

Best thing to do is ask your company if you can become a "service supplier" and then setup a micro company. You then pay R6k p/y and 6% of total earned in the year. You can then write off car, phone, house, medical and airtime and many other things. It does have its negative side but nothing stops you from doing this for a couple of years to build up a base then move back to company contract. Also, less money to government which is my main angle for doing this

Was one of those who had to submit supporting documents, submitted Tuesday 2017/07/04 01:25:22 PM and today got a letter of completion. Submitted logbook, IRP5, Medical and RA.

Looks like am due a rebate this year :D Filed for disability for my son and it makes a huge differance to my return. TBH though, I was swearing like mad last year paying for the therapies etc and still getting taxed on it :(

At least he's now in a special school where everything is included, can still claim those school fees back next year though!

The negative side being fraud? I'm confused as to how what you're doing is legit
A service provider is specifically excluded in section 2... All SARS has to do to catch you out is look at how much of your income comes from one source

Please educate yourself w.r.t. the Income Tax Act.

What you suggesting is creating a Tax Avoidance Scheme bordering on tax evasion.

If you are currently doing this already, I suggest you get yourself a tax accountant/lawyer before SARS starts gets wind of it.
