If you have read this thread at all, I have said numerous times, yes me.I also had a business fail a few years ago (tiny penis), and we tried setting up a similar arrangement with creditors that would have seen us turn the business around without needing to go the formal business rescue route or be liquidated. Unfortunately we had over 9000 specific creditors that were vindictive and were more interested in crushing the company, than getting their money back, and we were forced to go the liquidation route.
I have not asked before on this thread and I will ask now - are there any people active on this thread who are actually owed money by this business? Or is it out of a moral obligation that you keep jumping on the bandwagon to crush them?
Well, did you actively avoid any communication with your creditors? Did you give everyone the silent treatment. Did you lie to your clients and say you placed orders when you didn't. I contact the sellers, he either cancelled the order immediately (so he could get a screenshot) or just took a pic of the cart.Obviously he didn’t go into Voluntary liquidation. Otherwise the company would not be able to resume trading.
If he is continuing to trade while still owing refunds and doesn’t have the capital to cover those refunds he is in breach of the companies act. Any one of the people who he owes a refund to can file a motion for default judgement against the company, even if the amount owed is R50.00. If he can’t pay, the court has to liquidate the business, and that process is completely out of his hands.
So either, he has secured a loan from his larger creditors or come to some agreement with them, that has allowed him to pay all the refunds owed, and then continue trading to while paying off the loan, or he is playing with fire.
As someone who had been through something similar in the past and was also labelled a scammer and called all kinds of names (when I really wasn’t, business just went bad), don’t like how everyone is jumping on the scammer bandwagon here, but from what is clear as day no one on this thread has skin in the game, or if they claim they do, they are full of excuses about why they aren’t doing something about it.
If he is really a scammer, then continuing to run an insolvent business that is properly registered with the CIPC is a really crazy thing to do.
