Should I contest the divorce

Yea but bwana you cannot always just say fine, if her demands are excessive then backing down will not be good man. You need to stand your ground sometimes. If she wants more than say half of everything then how do you just say fine and hand it over?

I think its bull**** - If I ever got married, and then divorced - I'd go on the run before paying my ex...

I'm making 100% sure that you get what you came with when I get married, and thats it.

Indeed. She can't expect more than half but I imagine the kids if any will probably go to her and you'll have to pay for them. It was silly to marry someone in community of property especially if they weren't on the same level career/earnings wise. If there aren't any kids then I don't see how she can get more than half.

Since we dont know what she wants all we have to go on is that his own lawyer is recommending not dragging it out as it may well be an exercise in futility.

My divorce dragged out long enough that the fees alone cost me more that the bickering saved.

I think 18 years ago most couples married in community of property.
 
This is the kind of bull**** that makes many guy NOT want to get married. I know I'm already convinced I'm better off not married. **** that. Makes me ****ing sick.
 
If there's kids, make sure everything is in their names, so neither of you have anything to split.
 
No children. Grounds - 'irreconciliable differences'. We have fixed property and 'in-community'.

I could burn some but not a huge amount.

Everything will be split half, house, contents etc. Unless you come to you own amicable agreement. What you want . . . what she wants!

How old is she by the way? If she's still young and able to work . . . the judge will factor that in as well.

She can work as a stripper . . . 2010 is around the corner so she will be self-sufficient.

You're still not going into the details of WHY you're braking up in the first place. The way I c it is: you did some things that hurt her very much, if she did anything bad you would be telling us. So, if you're the guilty party and made a mess of something that could have worked, then take it like the man you should have been.

Close to half but the better half in terms of fixed property, investments etc. Of course, this also includes my pension which is meagre to start with. Accrual combined with what she needs would be a fairer split. This total would be less than half. Anything else just allows her to fulfil her thirst for revenge and the courts simply oblige (or act as the partner-in-crime).

OP, try settle out of court for a 50/50 split.
 
Seems to me like you're being hard-done by through the court's attempt at fair judgement. The assumption is that there is a 50/50 contribution by both parties to the upkeep of the marriage, but not limited to pure monetary terms.

Even if she never earned a cent, the court will hold that she contributed equally through companionship, keeping the house etc. This assumption will stand unless you can prove otherwise.

Don't drag it out. See if you can have a civil discussion concerning the details, and attempt to settle out of court. She will get half, one way or the other... IMO, of course.
