I think that the ISPA should include a list of all companies doing email based marketing and those companies should be forced to disclose where they get their contacts from. Getting removed is all good and well but your name just finds it's way onto the next list and you never get to the root of the problem.
It would also be nice if ISPA could start opening dockets against these guys.

section 45 of the ECT Act is broken so this is tough but some dockets have indeed being opened
i think it is broken because it allows mail to be sent on an unsolicited basis first up....so spammerscum.co.za can send you mail and the onus is on you to opt-out or take other steps. if you mail them back to ask where they got your details you either get ignored or told that your mail addy was picked up off the Internet.
in SA, imho and given the fact that most users are clueless, an opt-in system would be preferable. there is a chance that we may still get ssuch a system when the consumer protection bill is finalised,
where section 45 can be effective is where you have opted out and they continue to send you spam...
