Telkom ruling sends shivers down the spine

WHILE it may remain difficult to deal with the devil on an equitable basis, the Supreme Court of Appeal last week made it a lot easier to call telecoms monopoly Telkom to account.

Last week’s 66-page judgment by Judge Louis Harms and four others presented a worrying insight into the way Telkom operates, and should send a shiver through all companies that do business with Telkom and down the spines of all its investors.

Some gems from the judge,
“in the review application, Telkom performed another dizzying pirouette”, how the company used “verbal manipulation” throughout, and how there were many “instances of Telkom’s inconsistency in the conduct of its case”.

Harms said Telkom offered eight different versions of events.

Harms said “Telkom did not even bother to provide us with the factual foundation for this submission” but, when asked, it then claimed “irrationality was a species of gross irregularity”.:eek::D Ultimately, Harms said “there is no basis for any of these attacks”, and upheld Telcordia’s claim.

I am about to wet myself with laughter here.

While I'm supremely chuffed with the ruling (and the way Telkom was ridiculed for behaving like a petulant child) I wonder if it'll come to anything or if they'll try to pull the usual strings.

I really, really want Telkom to get their comeuppance.

Great article!

Wouldn't touch Telkom with a barge pole if I was a company going for a tender. Glad that Telkom's shenanigans have finally caught up with them, playing games and hiding behind their lawyers is just not the ethical way to do business. Hopefully they will try to shape up a bit now but old habits die hard.
 
as i have always stated the only winners in any dispute are lawyers...always lawyers. nice R50m bill they got there.

they must of at some stage pulled the whole "chewbacca" argument that was spoofed in south park episodes a couple of years back.
 
I think the lawyers working for Telkom became 'absorbed' in the company's arrogance and also started to think they're untouchable & above the law. :mad:

But, at the end of the day (ol' cliche!) the poor ol' SA citizen will have to foot the bill for this arrogance. :(

It always amazes me that we allow this to happen on a daily basis and do nothing about it.

I made a promise then, that I will never ever use them again - even in the future and under new management.

Even if they provide 50Mbps for R10 per month with no cap! - I will use the next best guy.

This company has really damaged growth in South Africa

I've heard many stories like this where people just refuse to use Telkom, even if it entails a few sacrifices. You are right about new management, nothing has changed. I think that the company is so used to doing business as a parastatal that it will take something big to change the mind set and a new CEO is just not the 'thing' that can do it.
 
Hmm... so, does anyone know where a copy of this judgement is to be found?
 
I want to see how this ends up. Telkom could end up being quite badly stung with this news.

Well Im sure Laugh it Off can whip up a suitable shirt but then again I don't think Justin Nurse feels the same way about Judge of Appeal Harms:

I sense though that Telkom may be pitching in some respects for an opportunity at a Con Court appeal (all the jazz about Administrative law etc ...) and I have to wonder whether the CC will give them audience on the matter

Yeah!

I'm not so sure that everyone will be so happy when a new entry appears in the debit column on their invoices saying Telcordia - R**.**.

Lets face it, thats what it amounts to! :mad:
