Telkom surrenders to Hellkom

Hey peeps - thanks for all the words of encouragement :) It does seem as if Telkom quite abruptly changed their minds, there was a long period where they were very, very quiet, I thought their legal team forgot about Hellkom :( perhaps the fact that I applied for a court date caused a bit of a stir, and if so then good.. rather do something than sit back and wait for it to happen, right?

The battle is still not over though, Hellkom was started to inform people about how Telkom is ripping them off and how they are widening the digital divide with their prices, and this will stay the mission of the site. There will still be no mincing of words and things will continue as usual.

Thanks again to everyone and all the support! It's been a great help in the days since Telkom so kindly furnished me with a 399 page notice of motion :)
 
o cool,so lawyers do server a purpose ;) well done dude, good to see, i reckon they just didnt want the court to say in their final statement, " the case brought against hellkom is invalid due to the fact that the alleged damaging statements are not statments but truth." would hurt them bad for a court to say that.
 
or 'a generally corrupt relationship'

or maybe they would have implicated Telkom by saying that Telkom 'had a generally corrupt relationship with... itself'

Gregg suffered in many ways because of Telkoms action. They should be forced to pay substantial penalties and compensation.

This is the problem with corporations, they always rush in to demand the rights of natural persons when it's to their advantage, but do their damndest to remain above the law otherwise!

You had the balls to do what few other people have done. I admire your guts and determination to stick this out.

A huge thanks to all the guys (including legal) that have helped MAD out.

I agree with you that the fight is not won, but this is a huge inspiration to the rest of us to continue to fight for cheaper , and more widespread broadband.

We fight on............
 
Congratulations Greg. I'd like to see a copy of the return letter that went to Telkom, as you well know I have a certain "vested" interest in reading up on your response.

Today is indeed a very good day for the consumer, and freedom of expression, in South Africa. I think other corporations will think twice now, before infringing on an individuals' right to express on the internet. Having a big company like Telkom withdraw from a case like this hasn't set a legal precedent, but it sure has sewn some doubt about the chances of success amongst the more lititgously natured companies and lawyers.

It is well known that Telkom has one of the biggest, best populated legal departments in this country. In fact, if Telkom stopped being a telecommunications company, they could easily survive at being a law-firm.

I must say, it seems that Cape Town is indeed the bastion of free speech and constitutional rights ;)
