Van der Vyver looks to UN for payout

Cape Town - Fred van der Vyver, the man acquitted of murdering his Stellenbosch girlfriend Inge Lotz in 2005, has approached the UN Human Rights Committee in an attempt to win damages and recover costs for what he believes was his unjust treatment by prosecutors.



An application to the committee, drafted by senior advocates Dup de Bruyn and Barry Pienaar, maintains that Van der Vyver’s human rights were compromised.

It also argues that the government should pay damages to him. The complaint was filed with the UN’s Geneva head office.

Ryan Tutt, a member of Van der Vyver’s legal team, told the Cape Argus he had been instructed not to comment on the specifics of the complaint.

“We do not wish to comment… save to say that it relates to the violation of our client’s rights in terms of the preamble and articles 7, 9 and 17 of the International Covenant on Civil and Political Rights, to which South Africa is a signatory state.”

Article 7 prohibits torture and cruel, inhuman or degrading punishment. Article 9 recognises the right to liberty and security.

Article 17 mandates the right of privacy. It protects people against unlawful attacks on their honour and reputation.



Lotz was murdered at her flat in March 2005. Van der Vyver was charged with the murder, but acquitted in 2007. He successfully sued the police for R46 million, but the decision was reversed on appeal.

Lotz’s parents lodged a civil case against Van der Vyver, but it was settled out of court in 2009. Van der Vyver then made an unsuccessful approach to the Constitutional Court.

I was under the impression that the civil case was dropped.

I dunno.. it’s a tricky one with motive but also general incompetence by the police derailing it so badly that you not sure who did it. Strikes me as odd for the injuries and lack of anything else for it to be a stranger. Just saying..

I know it was 2005 but looking at the evidence and how they “tested” the hammer etc uh .. makes you wonder how people get arrested if they have the funds to fight conviction.

If you read that 1st line you’d see why I picked up on this case. Commented on this topic as it’s the only related on I found?

The way evidence is presented, what’s been found how it was botched the news on many, many years later makes you wonder if the police got better? Or they relying on people to incriminate themselves.

Interestingly in the US I’ve seen documentaries where the evidence is way thinner but they convict. So yah.. it’s a fascinating case as the injuries are not what Id think you would see for a random event.

This letter is going to be a bit more difficult than email (can't delete and make changes over and over), but I must get these little things off my chest this morning.

I am sorry you left here this morning so confused - I was initially unreasonable and consequently the whole thing got out of control.

Firstly, about you and your brothers... I pray that God will give you wisdom on how to handle the situation and that you will be able to resolve the issues between you. The little things that are bothering me at this time...

I am really sorry about some of the things I said this morning. My biggest mistake over recent times must have been to find my security and solution to my low self-esteem in you instead of in God. I would imagine you are familiar with the skill known as "writing" which involves moving a pen or similar device on paper to make marks called 'words".

It is, in fact, possible to use the same device to make marks on the paper that resemble faces.

Off topic but.. interestingly we haven’t had a solo female killer/suspect in SA.

I mean yes there was that satanist/cult thing in Krugersdorp a handful years ago but that was a few persons involved incl. a guy.

Or am I forgetting one.. Sa sure had quite a few news worthy murders & serial killers. i see Cpt might have another one targeting people in informal settlement.

That letter by the way - first time I've seen it and it looks really, really fishy. It reads like a bloke thinks his girlfriend would think and write.

Is that some firm of sorcery?

Debris uses a quill and ink, on papyrus parchments.
