My vehicle were in an accident while parked, no occupants.
I have spoken to the Company that caused the accident 3rd party insurer.
They made me an offer, but it is less than half of what it will cost to repair.
Their offer will neither repair nor replace my vehicle.
What am I to do??
Any help appreciated.

What does your insurer say?

Are you insured? If so, let your insurer handle it. If not, it’s all up to you. Get quotes/valuations and present them with a fair invoice. Negotiate. If you’re not happy, see a lawyer.

Do you have comprehensive insurance yourself? How many quotes have you got for the repairs to your vehicle?

I had a similar issue. Car was parked at my offices. a colleague reversed into it (with an SUV and a towbar no less).

Wanting to avoid involving my own insurance, i claimed through his (outsurance).

I got multiple quotes, then they get their estimator to approve a total. It was so low that I threatened legal action with the assistance of my Mrs who is a lawyer. I actually managed them to approve a quote. the whole process was so slow and painful, I will never claim third party again.

Claim through my own, and let my insurance battle with theirs after.

Vehicle is not insured, i got several quotes, I explained to 3rd party insurer that my vehicle cannot be repaired with their offer, as it is less than half of quoted amount. I even offered to supply most of the parts, out of own pocket. They persist with their offer.

Unfortunately they will do everything in their power to lowball you.
who is their insurer?

One of my problems here in Cape Town is all Lawyers i phoned so far does not deal with this type of claim.

I stipulated to Outsurance where the car is for valuation (CK COACHWORKS) and assumed they will use their valuation as a reference and validate.

So If i recall, outsurance suggested what coachworks to use, which was "Barloworld Coachworks"... I checked with a few places, i also named below etc.... memory is a bit sketchy, this is 6 years ago... but here you go:

...............................................................................................
I do not accept the payout suggested, that i was sent yesterday.

i was just informed by CK COACHWORKS that the value you gave, is NOT based on their valuation, but your own. Comparing it to two other external quotes, I am being severely under-paid.

What would the steps be in re-evaluation, and what time frame?

My wife is an an attorney at *******, I am going to give her all documentation this evening to take this matter further if need be, as there is such a high level of ambiguity in that document its ridiculous.
1) CK coachworks did the "evaluation", yet they give no monitary guidance?
2) Outsurance does their own evaluation based on ridiculously low labour rates (that I only know of because I had to investigate it, I am not a panel beater).
3) Lastly, Outsurance references BARLOWORLD repairs in cape town, who just told me that Outsurance is notorious for incorrectly valuating claims.

I also attached 2 external quotes.

Please note I was completely misinformed, and the evaluation supplied by your company implies that repair costs are covered, and it clearly is not.

Kind regards ..

So after a few follow ups, more days and days. they finally said I should get a quote from Barloworld, that I sent on, and was eventually paid for.

the difference between the repair was R5000. They offered R11000 and the repair was R16000.

Good Luck!

So If i recall correctly, I used claims of theirs against them. Basically where they meant to fully cover my repairs at an approved bodyshop for VW. And in effect, there was no practical way their total would come close to honouring that claim.

Thanks for the letter, I'll look into it. My Quotes at high is +/- R29K at low less than 27K, they offer R12500.

thats Massively less. mine was 30% under, yours less than half. you need to see what their commitment is to you, they also need to get the quote from an accredited workshop that can honour their quote (which wont happen obviously)

They had a assessor come look at my vehicle 3 months after the accident. I have send them all relevant paperwork, including accident report, quotes and more. The made eventually a offer, but I would be a fool to take it. My main problem now is finding a lawyer that can deal with this on my behalf, but apparently they only work on ones that make easy money," with apologies to those that actually still work".

So your vehicle isn't insured and it's got R29k worth of damage? Perhaps you should re- evaluate?

Don't most of these 3rd party always try to settle only a part of the repair costs, which is what they're doing here.
