Parliament turns down request to keep 'state capture' report safe

Parliament has turned down a request by outgoing Public Protector Thuli Madonsela to keep the "state capture" report safe in the run up to the application to stop its release.

"The Speaker has an obligation in terms of the Rules of the Assembly to table all documents received for the information of Members, in order to ensure that the business of the Assembly is conducted in an open and transparent manner," Parliament said in a statement on Friday night.

"This report however cannot be handled in the same manner," Parliament said.

It explained that Speaker Baleka Mbete received a request from Madonsela on Friday asking that she preserves and keeps the report safe.

On her last day at work, where she was expected to release a number of final reports and possibly the "state capture" report, Madonsela faced an application to prevent the report's release.

Co-operative Governance and Traditional Affairs Minister Des Van Rooyen joined the queue behind President Jacob Zuma to stop the report going public by applying to the court for an interdict against its release.

Maimane demands copy of report

Democratic Alliance (DA) leader Mmusi Maimane said as a complainant in the state capture investigation, he was entitled to receive a copy of the report compiled by former Public Protector Thuli Madonsela.

The DA leader said he has written to the new Public Protector Busisiwe Mkhwebane requesting a copy of the report.

“As the complainant in this matter, I am entitled by law to be provided with a copy of this report, which has been completed according to former Public Protector Thuli Madonsela,” Maimane said in a statement on Wednesday.

Good luck with that, I'd bet that the new PP will hide behind the looming court date.

IF the DA get their hands on it though I hope, and suspect, they will release it right away and face the consequences which will be minimal honestly. Better to ask forgiveness than permission ...

But Maimane says that as the complainant in the case he is entitled to a copy.

Yeah, but the only thing that will prevent him a copy thereof, legally, is the pending application by Zuma and van Rooyen to prevent the release of the document. Maimane and his legal people should know that, at least.
 
Wouldn't the "Access to Information" act make it possible for any person from the media / business / private world able to request the report?

I mean honestly it effects every single South African person directly.

Actually no, as the complainant they are entitled to view the report as it is complete. The interdict is against of the release of the report to the public domain.
 
Maimane's request appears legally founded. Within how many days must the PP respond to Maimane's request?

Could well be, as I have not read the exact wording of the applications of either Zuma or van Rooyen. If they specified only public domain, then well, he probably is entitled to it.

That is his (and his lawyers') legal opinion. The PP can easily have a different opinion, which means a judge has to decide yet again.

The PP's different opinion could be genuine, or it could be a delay tactic to favour 'ol Zumatello. Hopefully he gets a copy right away, then someone other than the PP and the Zupta camp at least has some control.

Cape Town – The new Public Protector will not be releasing the "state capture" report until the court has given her the go ahead.

Public Protector Busisiwe Mkhwebane was briefing Parliament’s justice committee on Wednesday, where the report on state capture took centre stage.

MPs, including Economic Freedom Fighters chief whip Floyd Shivambu, questioned her on when the report would be available.

"I think we unanimously agree as political parties that the report should be released," Shivambu said during the meeting.

Meanwhile, Democratic Alliance MP Werner Horn asked her to reveal the contents of the letter sent to Parliament by former Public Protector Thuli Madonsela to Parliament when she was requesting a safe place for the report.

An unfazed Mkhwebane fielded questions on the report, the backlog of cases, and allegations that she was a spy.

She refused to comment on the letter, and said the matter was before court.

She was in the process of preparing an affidavit, which was due on Friday, she said.

"I cannot release the report until the matter is finalised, the matter is sub judice. If I can be given an opportunity to respond on Friday," she said.

She was still consulting her office, she said.

"And I cannot commit to say tomorrow the report is released, because the court said it should be kept safe," she said.

She had not yet read the report, she said, which was safe and sound in the office.

"The report is kept safely in the safe of the head of legal services. I don’t have a safe in my office."

Questioned by African National Congress MP Bongani Bongo on the use of consultants to compile the report, and their security clearance, she said the report had been compiled by Price Waterhouse Coopers.

Consultants were also used, including former Commission for Gender Equality commissioner Janine Hicks, who was in quality assurance.

She would not say how much it had cost to get the report compiled by PWC, and merely said they would come back with a comprehensive report for the committee.

It would appear so. If the court gives the go-ahead, for releasing it, and she comes up with any excuse as to why it can't be released or its delayed in anyway, we will then know she is another Zuma puppet.
