WiMax spectrum conundrum

is ongoing at CCC - details difficult to get hold of but did see some documentation when i was there 2 weeks ago....
 
The Complaints and Compliance Committee (CCC) to adjudicate allegations of illegal use of 2.6GHz band ('the spectrum') by Screamer Telecoms in return for a fee to Sentech.

The hearings will be held as follows:

its not entirely clear in the notice on ICASAs webpage whether the case is against Screamer exclusively or Screamer and Sentech.
Is this a Zuma, Shaik situation; or will they need to take on all parties to the alleged (at this point in time alleged) contraventions?

I am a part-time sand engineer and general nuisance to inept and corrupt government. I spend far to much of my time doing legal and policy research and column writing - as opposed to loitering on the beach - and unfortunately am cursed by a law of remuneration of being grossly under or over remunerated for every piece of work I ever do.

@ least with this being public the media can give us an idea of what is going on (and how something which appears to be simple has dragged on for so long)

any chance of getting CCC proceedings streamed as a practice?
it would be a damn good way to get some accountability going - a PITA for the operator and I imagine a lot of CCC hearings will be of insufficient interest but there is value in establishing the principle. After all the SCA has guidelines on AV recording of proceedings and there is precedent concerning judicial commissions of enquiry.

Well I'll be arguing that in the communications industry public hearings should be open for streaming as a matter of course. Hopefully I'll be able to make the argument by Skype :D

This almost sounds like a good defence.

“Our argument would be that the CCC should always prefer the interpretation of the Electronic Communications Act that would allow for this sort of agreement because it’s an agreement that allows a licensee to meet its obligations. Unless the CCC finds that wording of the act prohibits such an arrangement, it should find it is consistent with what the act is trying to achieve.”

Returning to the issue of the validity of the contract between Sentech and Screamer, Motsoeneng said even if the contract had been valid, it was not sanctioned by the Electronic Communications Act.

“Sentech said the agreement was cancelled, but whatever they want to call the agreement, it is not provided for in the act,” Motsoeneng said. Meyer agreed, saying the act “doesn’t provide for such agreements”.

Interesting times.

CCC rules in November at the earliest.
Written submissions for final arguments to be in by 21 October and then oral submissions a week later.

CCC TO HEAR EXPERT EVIDENCE ON THE MATTER BETWEEN ICASA AND SCREAMER TELECOMS

28 May 2014

Johannesburg – The Independent Communications Authority of South Africa hereby notifies stakeholders and the media about the scheduled public hearing of the matter between ICASA and Screamer Telecoms. This follows a referral by ICASA to the Complaints and Compliance Committee (the “CCC”) in August 2011 in which the Authority alleged that Screamer Telecoms contravened the Electronic Communications Act; in that between January 2007 and May 2011, Screamer Telecoms was transmitting signal by radio or used radio apparatus to receive a signal by radio without a radio frequency spectrum licence.

The matter was first heard on 25 June 2012 and subsequently postponed due non-availability of an important witness. The matter was finally heard from 11 to 13 September 2013. It was at this hearing that it became apparent that the services of an expert witness in telecommunications was required to enable the CCC to fully understand the technical aspects of this case to enable it to come to a just and correct finding.

In order to secure the services of an expert witness, the hearing was postponed further and is now ready to be heard as follows:
