accident with no insurance help

Even I take offence to that. We should have a law in South Africa like in the US, where you may not be allowed to drive a vehicle that has no insurance. You are ignorant and putting others at risk with your disregard for others on the road. Lucky you, you just had a small incident. What if you were the "other person" and somebody, say, just like you, runs into your car and writes it off completely? Open your eyes!

Please explain to me how he puts you at risk if you have insurance on your vehicle?

Just a simple and short explanation will do :)

i drive with my seatbelt ...i maintain speed limit ....i maintain following distance ....i have perfect eye sight and i dont disregard other drivers ...my car is roadworthy and i follow the rules ...it was a small accident and the reason i dont have insurance is simple i cannot afford it ...

i dont have a business making money nor do i earn a huge salary. ...if i had the money for insurance bang i would have it ...

paying 1500 for a car a month ...and then you have to pay +- 1000 for insurance clearly doesnt make u richer

This is a bit harsh. The reason someone pays insurance is to protect their "investment" Which is why you are paying insurance. Whether or not the other party has insurance your investment is protected. Sure you might have an excess if you so choose but that is you protecting your "investment".

Even if 100 people drive into your car it is covered, if they don't have insurance it's not your problem. I fail to see how him not having insurance costs you money? Your insurance will reclaim the damages from him directly if he doesn't have insurance and pay you back the excess you had to pay. So you lose nothing

If too many vehicles crash into you, and they don't have insurance, and your insurance therefore fails to recover their money- your insurance will be cancelled and you'll struggle to get re-insured.

This is exactly what happened to an ex of mine.

Well apprently not, otherwise you would have had breaking space for this incident, if your eyesight was so good you would have noticed the traffic stopping. Every dude thinks he is Michael Schumacker. As you have just proven, you cant be trusted to drive safely. Get insurance.

Pitbull, he puts the risk of having to pay out (excess and over and above what insurance pays out) to the non guilty for repairs. Tell me now how that is not a risk (money wise, i never mentioned anything about health). Take me for example. I had an idiot reverse into me at an intersection 3 weeks ago. I did nothing wrong, was stationary with hand break up. Damage costs to my vehicle = R13K. I have to foot the excess for that and try recoup the costs legally from an uninsured person.... How does that not equate to a "risk" for insured drivers on the road?

No that I can understand it was just an example.
Who really has 5 accidents a year? :D

The point is, you should be paying insurance to protect your own investment/s not because you might have an accident and be the guilty part. I think this is the biggest misconception here. The reason the US has it as law, is because their insurance claims works differently.

That's the thing - we're not talking about taking out FULL COMPREHENSIVE insurance. we're talking about getting 3rd party insurance. That's for when you accidentally bump into somebody (remember, if you tailgate somebody, it is almost always your fault) and they want to fix their property. Or you have to serve out for something (because you're a good driver) and you crash into somebody else. My buddy drives a Tazz of a couple of years old with only third party insurance. His total premium (including his house and its contents) is R300 a month.

You will always be liable for the excess no matter what happens. You took the policy as such. If however the full amount has been reclaimed from the guilty person or their insurance you will be refunded. (You have the option to not have an excess ;))

As for recouping the money, that is not your problem, this is why you have insurance. If they fail at getting the money out of the other party it's not your problem.

Well when somebody else write your car off for you (even if you are 100% in the correct) or if say your car gets "affirmatively repossessed", let me and millions of other insured drivers tell you... we told you so. Enjoy paying that R1500 p/m for a vehicle you do not own or cant drive any more!

3rd party insurance should be compulsory for all vehicles on the road....regardless!! End of story.

Sorry buddy. If you can afford R1500 for a car. Then you should've got a car with a R1300/month payment, so you could have R200 3rd party insurance.
You live and you learn.

Why should I have to pay if someone else is at fault? If two uninsured people drive into each other and can't afford to fix their vehicles then both parties are pretty screwed.

We really need to go back to having compulsory 3rd party insurance at the very least.

^ What he said. Quite logical actually. Maybe the OP should just wipe out into Pitbull's car...and shrug his shoulders about the whole thing with Pitbull footing the complete repair bill. I wonder how that would go?

yeah i guess only i would know what happen ...i am not saying i am right...i acknowledge was my fault and now face the consequences

buddy ....did u maybe forget to read the parts my fault and i will foot the bill ....i have no problem paying but i am trying to minimise costs ....if you read my 1st post it clearly asks how much to replace ....

This is the reason people need insurance. Not to protect the other drivers on the road. It's to protect yourself. When will people realize this? I pay a pretty big amount every month on insurance. And this is purely because I want to protect my property and investments. I don't care if everyone else in SA doesn't have insurance, at least I'll be covered should something happen.

I have 100% cover on my vehicle at retail cost and no excess. He can run into my are all he wants. He will foot the bill with the insurance I'm covered with. I will be inconvenienced for sure. But I will suffer no financial loss what so ever.

And it would be clearly that intention that would make me as the other party in the accident demand you pay for the repairs in a manner I demand, not how you feel they should be done...and that would entail complete bumper replacement, as well as the car going into a chassis jig to check that the chassis is still straight.

You will when they push your premiums up.
