Article: Sangoma sick note valid: court

Her leave was unpaid. RTFA.

Regardless it is ridiculous.

As far as I am concerned you shouldn't get to just take leave unannounced when your boss says no and expect to keep your job.

This is africa - anything goes. Surprised they didn't demand to be paid as well!

To my knowledge sick notes are only legally binding for granting sick leave to an employee (if an employee is absent from work and submits a sick note from a doctor then the employer must accept it as sick leave). A school or university may accept or reject a sick note at their discretion when a learner or student is absent.

This crap needs to be taken to a Higher court immediately and a stop put to it.

She ate White Rabbit sweets.

Oh FFS they can't be serious and to think this is a "Labour Appeal Court" emphasis being on court.

Anyone, yes anyone, with more than 2 brain cells should know better that these are fraudsters and con artists with zip medical background and a court wants to accept their cr@p!! The soccer is a perfect example of this K@K.

Just shows how this country is going to ruins.

Yeah, sure, that one guy abused the system, but what about all the legitimate cases of ancestors tormenting people or bad tokoloshe spirits keeping them awake, now they have to get a bad rep too?

Technically, a hangover is being tormented by "spirits".

Who may issue one? And if a doctor lies?

Fine by me... Just make sure in future she gets refused treatment by other medical practitioners.
She needs to visits the sangoma for whatever medical assistance she needs.
So HIV treatment; stab wounds, broken bones, cancer treatment, open heart surgery - should all be treated by her friendly neighbourhood sangoma.

I cannot even begin to understand this. I know the sick note will be valid from a registered traditional healer, but you can see there was blatant abuse there. She took the time off to attend the course not to be healed. FFS!

Becoming a traditional healer is a calling from the ancestors. She wasn't following the path she should and the ancestors started harrassing her, until she got back on the path.

So she took sick leave, because of all the harassment from the ancestors. You try working with voices in your head. The only way to cure these voices was to become a traditional healer.

There was no abuse. The taking of the tradional healer class was actually the cure for the voices of the ancestors that was in her head.

Anyway that is how I understand it, by understand it, I mean its what the voices in my head told me. By voices in my head I mean my ancestors. :D

These three "judges" from the Labour Appeals Court have about as many brain cells between themselves as Zuma does. And people wonder why "African" culture is stereotyped as lazy.

I thought as an employer you are entitled to send someone with a sick note for a second opinion with a registered doctor(healer) of your choice?

The company appealed, and the Labour Appeals Court ruled in Mmelodi's favour, saying South Africa was a land of many cultures and that traditional Western culture could not be allowed to dominate the African culture of many of the country's inhabitants.

Yes - bring out the bananas for this republic! #SMH

This part of the article bothers me the most. To me it suggests we can decide when and when not to follow so-called "Western culture".

I think this needs to be sorted out by law. Take a nation poll on some issues (like healthcare in this case), determine what people want ("Western" or "Traditional") and make that the official requirement. Employee wants "Western" healthcare, employer needs "Western" sick note.
