Blacklist racists - ANC MP

The judiciary is already tied up enough with timewaster cases because our leaders consistently make stupid decisions. So everytime a person is blacklisted vindictively (and yes, it will happen...a lot), they have to take it to court?

The government can just use tax payer money like they always use in these cases they never stood a chance to win. What about the person that got accused of racism, getting represented in high court is gonna cost you a big bundle in lawyer & advocate fees alone.
 
Judiciary just follows the laws enacted by parliament. So you get blacklisted for saying Zuma is an idiot (I can almost guarantee you this would be acceptable criteria), now you have to approach the courts to have your name removed from the blacklist, by then the damage is done. Remember purple face where you were so quick to jump on the bandwagon, well those to kids are fscked for live, employer in future will google there name and the first hit will be 'students involved in blackface racism', nobody cares about what happens after the fact, pardons/exonerations etc don't make front page news. What if you don't have money to go to court like is the case with most people?

And then you have the definition of racism, this would be a moving target and ideal to silence any opposition.

I don't buy that. For a start, saying "Zuma is an idiot" is not racial and no judge in the land will cede to such an argument. Secondly no one will be blacklisted willy nily without the proper judiciary steps so your fears have no foundation. How come no one raises all these concerns with regards to pedophiles?

No, it goes to the courts before the blacklist.

Or corrupt politicians, or blacklist electricity thieves, even e-toll defaulters.

Why not start a list for everyone then.

So you are proposing each accusation first gets heard in court? Do you you have any idea what lawyers & advocates cost? It's not something average joe can afford I'm afraid. Secondly they would have to build new courts & appoint more judges for all the 'racists' claims, the amount of times something is deemed as racist these days is staggering, cry wolf.

But this is what happens anyway in any criminal matter. Or should we stop going after those accused of sex crimes because of the reasons you cited?

The accused will still have to fork out for defence. Even if the blacklisting fails, the person, if innocent, will probably have his/her career destroyed and suffer other consequences. In other words "blacklisted" in society. This, surely, is unfair.
 
Why don't they save all the trouble and just sign up all the white people as when we apply for our new ID cards?

You are describing the failings of our criminal justice system. That is not the fault of the laws themselves.

Very well then, you will have to deal with thousands of fake claims on a monthly basis then. We'll let the courts handle that BUT I would like to see the accuser face the same wrath if their claims are found to be false or frivolous ie your name goes on that list, you bare all the legal costs & if you can't pay the legal cost you go to jail. This would only be fair and would prevent false accusations & frivolous BS.

you can add Gareth Cliff's comments on free speech and Chris Hart's comments on "sense of entitlement post apartheid" to the list, anyone with even one brain cell in good working order should be able to see this is the epitome of a bad idea

So discrimination against minority groups based on their skin colour isn't racism?

Sure, but that doesn't mean that those calls can be justified before a judge.
