Daylight Robbery !!!!

Yeah sure.. "didn't know"... He's just playing dumb.

Ja, could be... but this is the first time I spoke to this guy... the previous two times it was a lady... and he did sound genuinely shocked and disappointed as if had just realized he signed up with a bad company.

I wonder what happened to the other lady. Maybe she also left. Hopefully word will get out about these guys and people won't want to work for them.

Beware of this type of scam.

1) The sales person calls your company and asks for the person who does the ordering
2) They tell you that you completed a survey a few months back
3) Now they are going to give you a free voucher or complimentary coupon.
4) They are also going to send you one of their "printer cartridges" to "test"
5) The call is recorded and they record your agreement to accept the vouchers and the cartridges.
6) Once they deliver and you or anybody in the company signs for delivery of the cartridge you are hooked.
7) They then begin to pester you for payment, usually over R2000 for a generic cartridge.
8) Meanwhile they begin sending you more cartridges for which they will also bill you.
9) When you try to refuse or return the cartridge they threaten to blacklist you for non payment.

The new Consumer Protection Act gives you the right to refuse or return these cartridges.

Hopefully the new Consumer Protection Act will put paid to these guys. They will no longer be able to refuse the returns.

Once the Consumer Protection Act (CPA) comes into effect in October 2010, refund policies will have to conform to the following guidelines.

Question of the Week: I recently bought a product from a mail order catalogue, but am not happy with what arrived in the post. Will the Consumer Protection Act make it any easier for me to return my purchase?

Yes, the process of returning goods will be much easier and simpler once the Act comes into effect. If you did not have a chance to see the product before it was delivered to you, you will be able to get a full refund if you return it within 10 business days. Read the information below to find out more.

refund

What you need to know:

* According to Chapter 2, Section 56, a consumer can return goods to a supplier within 6 months of their delivery, if the goods fail to satisfy the agreed standards and requirements (which state that the goods must be in good working order, free of defects etc – see Section 55 for details). This return must take place without penalty and at the supplier’s risk and expense.
* The supplier must either repair or replace the failed, unsafe or defective goods, or refund the consumer.
* If there is a problem with the repaired good within the next 3 months, the supplier must replace it or refund the consumer.

* Chapter 2, Section 20 states that a consumer can return goods to a supplier and receive a full refund within 10 business days if the supplier has delivered:
o goods as a result of direct marketing and the consumer has cancelled the agreement during the cooling off period (Read more about cooling off periods here). In this instance, the goods must be returned at the risk and expense of the consumer.
o goods that the consumer did not have an opportunity to examine before delivery, and has rejected on delivery (Read more about examining goods before purchase here). These goods must be returned at the risk and expense of the supplier.

* However, it is important to note that this does not apply where:
o The goods concerned have been disassembled, altered, permanently installed or combined with other goods; or
o There is a public regulation prohibiting the return of the goods.

* If the goods concerned have been used or need to be repackaged, the supplier may charge the consumer a “reasonable amount” for this inconvenience.

Interesting Fact:
The CPA is clear that these sections of the Act are in addition to any other right in law between a supplier and consumer to return goods and receive a refund. The section does not replace any existing rights.

Slightly off topic but similar story - couple of years ago I was hassled by a store credit card offer - (you know, before the bubble burst) - eventually, after the 10th or 12th call (they just would not take no for an answer) I said, sure, send it. When the courier arrived, I opened the envelope, cut the card into little pieces, put it back into the envelope, and told the courier to take it back. He just burst out laughing - never heard from those suckers again.

Just spoke to C & N Magda

I am not too sure what has happened but I am now stuck in this "battle" with a very rude lady named Magda (From C&N). She phoned me about a month ago and told me that the previous receptionist had ordered 2 ink cartridges that they "forgot" to deliver. They were busy with a financial recon and had just noticed it. She asked if she could deliver them and I would even get a Woolworths voucher. We received the goods yesterday and I was horrified to see that she had invoiced us over R2500 for 2 cartridges!! I thought that there must be a mistake so I phoned only to be screamed at and insulted. According to them they are so expensive because they last 5 times longer and they will not be accepting the goods back! If I do not pay I will be facing a legal battle.

I sent a fax and kept the journal- informing them that I do not want the cartridges and that they must send someone to pick them up. When I phoned to confirm that they received it she was very rude again and proceeded to tell me that even if they had received it they would not be accepting it.

I told her that she did not tell me the price and that I simply will not pay that for a cartridge. She then said that she did tell me the price and that she has a recording- I then asked her to send that recording to me and she hung up on me. Today she has said that she knows that she would have told me the price because she knows herself (so where's the recording then I'm thinking) and she will now be charging me interest and I can look forward to hearing from her legal team.

Does anybody know what I should do and should I be scared?

yes, was on carte blanche the other day. scam artists.

This company phoned me last week wanting to sell me some new kind of ink cartridge that supposedly lasts 5 times longer than a standard cartridge.

From my limited Std. 7 Natural Science knowledge I reckon the cartridges would have to be 5 times larger for that to be true. Or they disable all the buttons except "draft" on the print dialogue box. :)

My question then is do I have to pay or can I just send their ripoff products back. Our office lady signed a delivery note, but other than that there is no documentation proving that I agreed to these rediculous prices.

Send them a strongly worded letter setting out exactly what transpired, plus that you will take legal recourse.

Dude, the message your are replying to is 6 years old. :)
This thread is only still going because the company concerned is still running the same scam.
