Yep, and the annoying thing is there's a track day Sunday that I wanted to attend... urgh.

Damn that is an expensive car.

Can't believe that they charge that much extra for features that are standard on R200k Kia/Hyundai's.

Can't see myself ever buying VW, purely because of the excessive price. But if I could over that you have to contend with their F@#k you attitude and then finally the fact that everything on their cars are "extra".

Last I checked the VW Vivo electric windows was an optional, 2014 and electric windows is still optional on a new car

Anyway, good luck OP. You are getting screwed over here, badly. Personally I would go court route if the other avenues don't work out.

Thanks @Rouxenator for setting my mind at ease with regards to the tracking unit.

Guys I can appreciate the fact you are experiencing issues with your cars as well and need help but could you take the discussion to PM as I have sent a link to this thread to VWSA and would like to keep the current discussion on topic. Thanks :)

I have to agree with Gnone. The things VW see as optional extras are insane. Its not just the Vivo line, look at the Polo, the 1.6 has about the same power as a 1.4 Corsa and most of the things that come standard on other cars are optional on the Polo.

Anyway, that is OT, in all likeliness I think it is a sensor problem. These VAG engines are pretty bulletproof.

Sorry about your experience with VWSA. I left VWSA in 2005 because of anger at how they treated me. They denied an issue, I provided them with proof and they resorted to other lies. I ended up repairing my car from my pocket and vowed to never buy a VWSA product again. Funny thing I moved to BMW, bought a new car which turned out to be a lemon.

I bought a new BMW E90 325i in 2005 and experienced similar problems since day one. BMW never wanted to replace it, instead were keen to loan me cars while dealer attempted to repair it. At one moment, I was driving a loan car for 2 months.

Towards motorplan expiry, I wrote an email to BMW Germany, cc BMWSA telling them I could not keep this car beyond motorplan because of original manufacturer defects. They organised a deal with the dealer for a discount on my next BMW.

Mercedes has its issues too... with faulty cylinder head seals which leads to the electrical harness absorbing oil. They are also denying the issue exists in SA, and some astute customers located copies of the recall notifications issued by HO in Germany.
Still MBSA is in denial and refuses to entertain customers' valid claims.

All these stories are enough to make you not to want to buy a car again really... It just shows that its the luck of the draw whether you end up with a lemon. I dont think its all that common and each manufacturer should abide by some rule that states immediate replacement if a new vehicle is still continues to be problematic after a single repair.

The thing is we do have the CPA, it may not be as accurate for cars and houses but it is the law. If the manufacturer cannot fix or repair the car, given the opportunity to do so, they should offer the customer the option to replace/refund/repair. By not offering the customer a choice they are breaking the law. They can be forced to replace the goods and get slapped with a huge fine for not complying with SA's law.

Update is that the tracking device is removed and the car is going to undergo diagnosis now.

Unfortunately the CPA is the biggest lemon by far

Would love to hear the other side of the story, I suspect OP isn't telling all of it.

What are you inferring? That I some how abused the vehicle from the second day for the CEL to come on? This is not my first Scirocco. I traded my old one which I owned for over 4 years for the R. That car never ever visited the dealer unless it was time for its service.

Had the same with my 19" rims on my 335i which cracked easily. The insurance ended replacing the problematic rims after wheelcollisioncenter report.

Have a read of a similar case overseas involving a Z4 owner, BMW and the Arbitrator who ruled in favour of the vehicle owner.

The new vehicle warranty should cover the cost of reimbursement for the new tires under California Civil Code, section 1794.3 for the non-conformity.
