Defective New Scirocco R

The is an Ombudman and they're called MIOSA. I have sent all the relevant documentation to them as well as the National Consumer Comission last Friday.

I have already had a sit down meeting with VWSA's Regional Area Manager, Dealer Principal, Sales Manager and Service Manager on Friday, the 11th of April. This was after the first failed repair. I stated that I have given them an opportunity to fix the vehicle and now want a replacement as per the CPA. Their response was that they can not replace the vehicle as this cases evidence does not warrant it. I disagreed we basically came to a deadlock. They then said I can either open a case with the NCC and MIOSA or agree to the repair and I could think the decision over the weekend. On Monday, the 14th of April I gave them the second opportunity to repair the car. I'm done now. There is not going to be a third repair.

I have insisting on a replacement since the second repair failed on the 8th of May. They are now attempting a third even though I keep telling them I am not interested in the repaired car.

Yeah the original post contains most of the story to which I am continuously updating.

I meant, do you have written proof that you have requested this vehicle be exchanged? don't let it come to your word against theirs.

If you don't, fire an email to them saying as discussed on 2 previous occasions, i want this vehicle replaced or something to that effect.

/just making sure you covering your bases.
 
I will also NEVER buy another VW in my life. :mad:

I luckily never had to deal with their Sales/Service people, but the poor quality of their cars put me off the make completely.
 
Your best call would be to trade it in for cash and cut your losses. The further you go down this rabbit hole the worse it will get. Commented on both links and shared it.

Apart from the numerous apparently recorded phonecalls and the meeting with VWSA and the dealer I have 3 separate emails from the 2nd of April saying I want a replacement. I have sent these emails to the NCC and MIOSA as additional documentation as well.

It's totally unacceptable - they should replace it. This is not a cheap car and when you buy new they should give you something without any defect.
 
The problem with ombudsman's is they usually take forever as they're overwhelmed with complaints.

I've been sitting with an insurance one from January - got a response at the beginning of April, supplied more information, got acknowledgement of my email last week (6 weeks later).
 
Is a ruling by an ombudsman binding in this country? Or is that companies abide because of the potential reputation damage if they keep ignoring the rulings?
 
This is such crap. Total BS on the part of VWSA, based in the information we have thus far.

Sad thing is this, considering that it appears as thought VW have a vehicle, a new one at that, that is or has some kind of technical fault, which speaks of poor workmanship or that something has been overlooked on their part, and that on its own is a massive negative when you consider not only the price of the vehicle but the type of vehicle too.

But instead of owning up to it, taking the customer's complaints to heart and after the second failed attempt at repairing it, to just replace it or at the very least to do more to ease the concerns of the customer, as well as his inconvenience, they stuff it up. Considering that its their vehicle that is problematic, I would have been willing to overlook the issues with the vehicle if VWSA had assisted the customer in a way that should be the priority of the "peoples car".

Poor form VWSA.. poor.
 
Not inferring that you damaged the car in anyway or that it is your fault in anyway, want to hear what VWSA and the dealerships have to say about it.

Your logic is so flawed its unreal, i have had to deal with VW for my scirocco my brakes started sounding like a truck in the first six months, oh no its according to design they said, the thing grooved my discs. Eventually i threw a massive fit and go them to change the discs and the breaks at their expense. I love my car, but VW the brand in general are utterly pathetic.

Are you sure the tracking device does not cut into the fuel supply remotely?
There are some tracking devices that will cut fuel to the vehicle when they need to.
This could be the problem?

Very few situations where this happens. His tracking unit was a simple ignition on unit which only interaction with the vehicle was to go on when the car is running and record positioning (GPS) data.
 
When was the "removal" of the tracker scheduled again?

I recon, considering the cost of the vehicle, I would have gone to a lawyer immediately.
 
Interesting though because recently I know of someone with a Tiguan and a Netstar tracker also having many back and forth dramas because they wouldn't play nice together.

Don't know the details though.

Its a possibility, I cannot see how VW themselves cannot diagnose the problem on their new cars, its should be quite simple especially when the problem has been escalated so high up.
I also think this is an older engine from the golf 5 so it should be bullet proof and tested by now and easy to find issues by the technicians since its been in production for so long.
 
For the tracker to be able to cut the fuel line it will be a much more complicated installation requiring it to either be connected to the fuel relay or CAN bus. The OP has confirmed that neither of these are the case and the unit was a single wire (ignition on) installation.
