CAPE TOWN - Prosecutors in the United Arab Emirates (UAE) have told Professor Cyril Karabus’ legal team they intend appealing the decision to find him not guilty of manslaughter.

Last week, an Abu Dhabi court found the elderly professor not guilty of manslaughter and forgery.

A medical committee cleared the paediatric oncologist of all blame for the death of a young cancer patient he treated there more than a decade ago.

The latest development means Karabus will remain in the UAE indefinitely.

His lawyer Michael Bagraim said, “We’ve heard incredibly bad news, it’s almost sad news. The reality is that the prosecution has now indicated it wishes to appeal [the earlier ruling]. This means he is not coming home and they are not giving the passport back to him.”

Karabus was arrested while in-transit in Dubai back in August.

He was travelling from Canada to Cape Town.

Karabus’ family was hoping he would be home in time for 78th birthday on Monday.

What the hell is our government doing to bring Karabus back - or would they prefer the 78 year old come back the same way as some of our soldiers. :mad:
 
They're doing nothing, because that part of our government is useless (like the majority of the rest of it)
 
After all the problems that Karabus had experienced previously in the UAE why would he return there in the first place? Passport control authorities in the UAE should be very thorough due to the possibility of hijackings or planned military operations by hostile Middle Eastern countries.
 
I don't understand how you can blame the South African government on anything...

Not that I'd ever work in a non-secular country.

As per the original article: Karabus was arrested while in-transit in Dubai back in August.

He was travelling from Canada to Cape Town
 
He was technically in UAE territory and presumably flying with a UAE carrier such as Emirates. Surely he realised that he might be arrested for a previous incident?

The World Medical Association (WMA) will advise physicians around the globe about the risks of working in the United Arab Emirates (UAE), triggered by the legal action against retired doctor Cyril Karabus.

The Cape Times reported on Monday that the WMA sent the advisory to its 102 member countries following a council meeting in Bali last week.

The WMA passed a resolution saying it believed Karabus was being treated in a manner "which fails to meet international fair trial standards and he should be allowed to return home immediately".

The SA Medical Association (Sama) first pushed for the WMA to call for health workers to boycott the UAE but settled on the advisory instead.

Karabus, 78, a former Cape Town paediatric oncologist who was detained in the UAE for about eight months, was recently acquitted of manslaughter and of falsifying documents after the death of a three-year-old Yemeni girl he treated for leukaemia in 2002.

Last week, the prosecution announced it planned to appeal.

Karabus told the newspaper on Sunday that he was set to appear in a UAE court again on Tuesday.

He did not believe the WMA advisory would affect UAE authorities.

"I don't think they care... I don't think they'll take too much notice," he said.

People should know better by now.
Don't do business with fanatical crazy religious peoples and governments.

The real loser in this case is all the future "little girls with cancer" :(

I feel so strongly about this... health care professionals need to know what they are getting into when they go over there.
They need to look at how one of the best Pediatric oncologists in the world is being treated.

My sister is over there now and has basically made her money and is ready to go. Sure in many ways it might be better money than working here and a bit more safer but their attitude towards somethings is beyond bizarre.

Patients may not die, no matter what the condition. Even if its a 93 year old with cancer... its a real problem if they die.

People need to wise up and leave those madmen to their stupid ways
 
SA Government Wants Karabus Appeal Dropped

The government urged on Monday that the appeal, in the United Arab Emirates (UAE), against the release of local doctor Prof Cyril Karabus be dropped at his next appearance.

"We are hopeful, therefore, that tomorrow's [Tuesday] [court] hearing [in the UAE] will not culminate in a further postponement," Deputy International Relations Minister Marius Fransman told reporters.

"It is now really time for the professor to be reunited with his family. The South African government trusts that justice will prevail..."

Speaking in Johannesburg, Fransman said Karabus would appear in court on Tuesday for a second time in his appeal case.

The 78-year-old paediatric oncologist has been detained in the UAE since August 18, after being sentenced in absentia for the death of a Yemeni girl he treated for leukaemia in 2002.

He was acquitted on the charge on March 21, but was not allowed to leave the country as the prosecutor appealed the court decision.

The appeal would be heard in the Abu Dhabi court on Tuesday.

Fransman said he travelled to Abu Dhabi on March 3 and to Dubai on March 17 to engage with authorities on the case.

"As a democratic state, we do respect the sovereignty and the independence of the judicial system of the UAE," Fransman said.

"We call on them to withdraw the appeal."

He said Karabus was "strong" under the circumstances, but that this did not mean there were not difficulties with his health.

The appeal case of local doctor Cyril Karabus in the United Arab Emirates (UAE) was postponed on Tuesday, the international relations and co-operation department said.

Spokesman Clayson Monyela said the case would be heard on Monday.

He said while the government respected the independence of the UAE's judiciary, it believed Karabus's right to a fair trial was being violated.

"We are disappointed that the judicial authorities in the UAE have once again seen it fit to further prolong the stressful ordeal that Prof Karabus has been going through since August 2012," Deputy Minister Marius Fransman said.

"The South African government will continue to raise its concerns through the relevant diplomatic channels with the government of the UAE."

The 78-year-old South African paediatric oncologist has been detained in the UAE since August 18, after being sentenced in absentia for the death of a Yemeni girl he treated for leukaemia in 2002.

Where's the rest of the info? Delayed based on what? This is pretty pathetic, seriously, i wish i could go there and slap someone.

Delayed based on the prosecution appealing the decision, because they can't comprehend how and why the verdict changed.
They now claim that the patient's life-support machines were switched off before she was clinically brain-dead, so now they're running with that.

Bunch of bullies to say the least.

No, but we know they were appealing, but why was today's appeal hearing delayed until next week ? The appeal hearing was set and everyone said it's standard procedure to appeal over there. Supposedly after that it's over and done and the doctor would be home within a day after the appeal hearing.

Yet now the appeal is delayed, you can see it as "delaying the delay" .

In other words, why didn't they do the appeal today, as scheduled ? I mean it's one thing to appeal and have this thing drag out, it's another matter when the appeal date is moved out without any reason....

They going to struggle to get foreign doctors there if they treat them like this.
