Making a mistake and blatant cheating are not the same. One should be punished. Or be fair and just let the cost cap thing go.

Exactly, if they get a slap on the wrist surely everyone will just do the same thing from here on.
 
Leave RBR cost cap for this year as set then for everyone else raise Cost cap by the amount of overspend adjusted for inflation.
They probably spent the money on buying every team member a NETFLIX subscription to watch DTS. :unsure: :laugh:

An almost equivalent and viable sanction (and one allowable within the regulation) would be to decrease RBR's cap by the amount they overspent last year. Or perhaps even reduce next year's too by the same amount. Something along those lines.

I was actually joking but the penalty you mention is probably the most dangerous option the FIA could take.
It will send out a message that it is safe to overspend this year to win the championship as long as the new design in question will carry over for two more years to offset the penalty.

Then drop the cap by 200% of what was overspent? Repeat offenders and major breaches should attract more severe punishment.

One of the problems the FIA have here is that punishments were left vague in the wording so now they have to determine precedent with this first transgression.

Red Bull admits "surprise and disappointment" at FIA's breach claim

Reacting to today's claim by the FIA that it breached the 2021 budget cap, Red Bull has expressed "surprise and disappointment" at the finding.

The reaction comes as the sport waits on the FIA to announce what action will be taken against the Austrian team for the overspent which is thought to be around $2m.

"We note the findings by the FIA of 'minor overspend breaches of the financial regulations' with surprise and disappointment," read a statement from the Milton Keynes-based outfit.

"Our 2021 submission was below the cost cap limit, so we need to carefully review the FIA's findings as our belief remains that the relevant costs are under the 2021 cost cap amount.


"Despite the conjecture and positioning of others, there is of course a process under the regulations with the FIA which we will respectfully follow while we consider all the options available to us."

Having already threatened action against Mercedes and Ferrari for their def(l)amatory claims, it remains to be seen whether Red Bull might now be considering targeting the FIA.
 
@Sinbad skip to the 1 minute mark to understand why tractors are bad. It's basically the same as an ordinary car going underneath a truck trailer, all the safety means 0, you just die.

So Haas should just overspend 3mil on catering next year and they would win the championship?

The vagueness is only in terms of the extent of the sanctions specified. In the absence of specificity you’d think that the FIA would hear submissions from compliant teams as part of a consultative process to form the baseline for the deliberation and ultimate determination then by the FIa. I’m sure it’d probably have been better to just have a minor breach have an absolute penalty (cash and points) based on each 100,000 over the cap and a major breach being a DQ and forfeit of all points.
