Will be worse than Jo'burg municipality billing system - and that is saying a lot. :)

E-Toll billboards to stay for now

DA billboards poking fun at the ANC about e-tolling will stay up as long as possible on Johannesburg's highways, spokesman Mmusi Maimane said on Monday.

Asked how long the Democratic Alliance intended keeping the billboards in place, he said: "As long as they can."

The billboards, visible along the N3 and N1 highways, read: "E-tolls. Proudly brought to you by the ANC."

Maimane said information related to the company involved in the billboard and the details of the contract would not be made public in consideration of the company.

However, the billboard itself was a secondary issue, he said.

"The critical issue is the ANC must defend its own policy that it implemented," Maimane said.

"... Sanral [the SA National Roads Agency Limited], at the recent e-tolling hearing I attended before the Supreme Court of Appeal [in Bloemfontein], said they were beholden to a Cabinet decision."

He reiterated that the DA was "absolutely" ready should the ANC challenge the validity of the billboards.

"Nothing has changed in that regard."

The billboards raised the ire of Transport Minister Dipuo Peters earlier in the day. She said they were the work of cowards.

"[These are] people who don't have the decency to actually acknowledge what the ANC government has delivered in this country," she said at a business breakfast in Midrand.

"[They] want to focus on one aspect and turn an important infrastructure of the economic hub of South Africa... into a gimmick."

Maimane said he had always acknowledged the progress South Africa had made as a country.

He cited his disagreement with Economic Freedom Fighters' leader Julius Malema, who said last month that the African National Congress was worse than the apartheid government.

What was cowardice, was the announcement while President Jacob Zuma was out the country on September 25 that the Transport Laws and Related Matters Amendment Bill had been signed, paving the way for e-tolling.

Zuma was in New York for the 69th session of the United Nations (UN) general assembly at the time.

The presidency said the bill was signed into law on September 21, before Zuma left for the UN general assembly.

Maimane said: "We have stated it is our billboard and we will stand by it."

ANC spokeswoman Khusela Sangoni-Khawe said the ANC had noted the DA's involvement in the billboards.

"We've noted that the DA have put up the two billboards and we are not going to comment any further," she said.

Who bribed whom?

As I see it, the only rational explanation for the many irrational decisions that were taken on e-tolls is: corruption.

  • Kapsch will be earning R 700,000,000 per year from collecting toll money.
  • The construction industry is massively corrupt.
  • Why have SANRAL always been so secretive about their finances?

Follow the kickbacks and all will make sense.

The billboards erected along Johannesburg's highways next to e-toll gantries are the work of cowards, Transport Minister Dipuo Peters said on Monday.

"[These are] people who don't have the decency to actually acknowledge what the ANC government has delivered in this country," she said at The New Age's business breakfast in Midrand.

"[They] want to focus on one aspect and turn an important infrastructure of the economic hub of South Africa...into a gimmick."

The DA commissioned the billboards, visible along the N3 and N1 highways, and which poke fun at the African National Congress and its role in the electronic tolling saga.

The message on them reads: "E-tolls. Proudly brought to you by the ANC."

The DA said on Sunday that it had commissioned the billboards.

"E-tolls were conceived under the watch of an ANC minister, supported by an ANC executive in Gauteng, passed into law by an ANC majority Parliament and signed, sealed and delivered by an ANC president," the Democratic AIliance's Gauteng premier candidate Mmusi Maimane said.

Peters said people who did this did not have a place in South Africa.

"We really don't have time for such people," she said.

Earlier, Peters said e-tolling in Gauteng would probably be implemented by the end of the year.

"Last week we finalised the regulations and this week we will be dealing with the tariff structure and starting the process to...publicise the tariff structure."

The tariffs would be publicised for 30 days.

"After 30 days I'm sure it will take seven to 14 days to get the ball rolling," she said.

The Supreme Court of Appeal reserved judgment late last month on a legal challenge to e-tolls by lobby group Opposition to Urban Tolling Alliance.

Peters attributed the system's high cost to the technology being used.

"It's imported and we have to pay for it. Just like your cellphone, just like any other technology that we use," she said.

"As a transport sector we'd be very happy to say give us all the money that the government has and reduce the money for schools, reduce the money for building other social infrastructure, reduce the money for pensions for the aged, reduce the money for feeding children in schools. Is that what South Africans want?"

She said the objective of the Gauteng Freeway Improvement Project was to decongest road networks. If people did not want to pay they could use alternative routes.

"We have also created alternative routes to make sure that those who are unable to get onto the freeway, those who don't want to get onto the freeway, those who don't want to pay, can use the alternative routes."

Peters ruled out the suggestion that the fuel levy be increased to pay for the system, arguing it would be unfair for the rest of the country to pay for Gauteng's roads.

"Somebody who is in Mbizana, who does not even have a road to get to school, must pay for the Gauteng freeways...Do we want to exacerbate the inequalities in the country?" she asked.

Adams & Adams senior associate of trade mark litigation Alicia Louw said after recovering from her initial amusement, she wondered whether there was any action that the ANC could take to have the billboards removed.

She wondered whether the signs violated any of the laws and regulations enforced by the Independent Electoral Commission (IEC).

The advertisement was unlikely to be regarded as ordinary infringement of the ANC trademark, which would require that motorists be confused into thinking that the advertiser was the ANC.

You should know that Lawyers don't like to give legal opinions where there has been no court finding.

They just don't operate that way.

Is she talking about the corruption, the job losses, the nepotism, the racism, the country's image, etc, etc, etc ?

Yes, the ANC has delivered a lot of negativity !

That's not true. We give opinions precisely to analyse the legal matrix and recommended course of action. If it is an opinion on probabilities of success, then this of course means there has been no court finding.

You know exactly what I mean. No lawyer is going to go on record in the media in such a sensitive matter with a conclusive legal finding.
 
I don't see the boards lasting very long if the ANC push against it. For example "Expensive out of bundle data brought to you by Vodacom!" that was paid for by CellC, it wouldn't last the week. The situation is similar. Even more in favour as the ANC never technically sponsored the e-tolls, it was local government.


I think the DA should have held this card for a bit longer, imagine these ads day of e-toll going live or the first week where users get their bills... that would have been epic.

There is nothing the ANC can do about the Billboards. They do not violate any laws. :D

No lawyer is ever going to give you a conclusive legal finding ;)

But yeah, there may be merit in the DA having used the ANC's trademark without its permission, but I'm no Trademark expert.
