I bet they're just doing this because they know they're going to get nailed when the consumer protection act comes along... so much for never disconnecting you... I'd say this is definitely a case for the ASA.

Wonder when its going to start affecting their fanboys :p

maybe the "fanboys" are more of the reasonable kind of user who doesn't need to be downloading 24.7...

Effectively, the argument "uncapped" means unlimited, meaning you still have internet access and can send\receive data - but they can limit your speed.
"Capped" means you have a certain amount of data before your connection is terminated. Mweb advertised an "Uncapped" account and terminated you, therefore you can slap them with false advertising as they effectively enforced a cap on you.

Dont know if I am explaining it correcly, but just read the case file in the link and you'll understand
 
It would be interesting to know off hand the usage stats and a (truthful) status on whether the people disconnected have been bypassing the shaping. Not saying you're lying at all king_kraig - just that some might, you never know.

Mweb should do a wall of shame and fame with the fame bit being like Openweb had (has?) and a list of people who've been disconnected and why. It's much cooler and it puts knowledge in the public domain instead of all this secrecy.

I generally don't check my usage - if I see something I want I download it - I didn't get uncapped so I have to stare at my usage counter and make sure my cost per gb drops below a certain threshold.

MWEB have claimed they don't disconnect you if you follow the 'rules' so lets here why king_kraig was disconnected if he didn't try and bypass their shaping, etc.? They're now probably going to claim the download manager T&C - which is impossible not to use if your line is running at a fraction of the speed.

Clause 4.2.1 of Section II states that advertisements should not contain any statement or visual presentation, which directly or by implication, omission, ambiguity, inaccuracy, exaggerated claim or otherwise, is likely to mislead the consumer.

The complainants are of the opinion that the advertisement is misleading as the word “uncapped” implies limitless Internet access. The service, however, is limited to specific amounts of data. Once the stipulated limit is reached, the connection speed is significantly reduced.

The respondent submitted that it is not selling “unlimited” ADSL accounts, but “uncapped” ADSL accounts. Because the user will always have an Internet connection, irrelevant of bandwidth usage, the package remains uncapped. Users who download more than their allocated amount of data are restricted in terms of access speed, but will still have Internet access.

king kraig been disconnected for net usage, I doubt its got anything to do with how he got to the total but more that he did...imho...
 
@MwebOps, Can you please clarify the situation where King_Kraig says he did not bypass any shaping rules and you are now disconnecting his account?
 
oh yeh... & I remember a certain MWEB CEO, Mr Rudi Jansen, stating on Talk702 a while back that he doesn't care if users download TB's...yeh right dude. FU again

*shrugs* i suppose RS and alike can be seen as bypasing since it's via HTTP. i doubt it that we will (or any other isp) give exactly clear do's and don'ts on their uncapped. afrihost tried to be transparent and had to run with their tails between their legs.

some isp might be returning a few pies to afrihost and mweb very soon.
