What MWEB should do is simply impose a soft cap at 250gigs. Maintain their current shaping/throttling and impose a soft cap at 250gig...

More or less. I don't understand it and how it is being applied by mweb.. But the concept yes.. But unless shaping is applied consistently 24/7 it's not the same as a soft cap... A soft cap would restrict a 4mb line to say 384/128 once the 250gig cap had been reached from the time it was reached till the end of the month...

try the torrent test. i'll take a bet you get at least 100 kB/s ;)

Please refrain from such speculation at this point in time, we simply have not observed enough to definitely come to those conclusions, right now your statements (regarding quantity vs method) are just fuel for a growing fire.

Lets rather observe more and see what happens, instead of taking such extremist views so early on, I'm not saying you are incorrect I'm just saying lets not be so hasty.

It is applied 24/7. Why restrict your users with a softcap when the network can be utilised by them when the speed is available?
 
Soft Cap is an archaic method of preventing network congestion, a more effective means is to throttle a % of the top users. Right now, a 20% user throttling would work, it keeps the leechers from leeching too much.

.. do you even believe that? What there is, is a few "die hard" users on MyADSL who are attacking them for this and thousands of remaining users who don't care that the top few downloaders who bypass shaping are kicked off the network. Can you really dispute this?

And no one else who isn't pushing 400+GB, most likely through a VPN etc, will have their time come. Wow MyADSL is great at making a huge story out of almost nothing. Shame for the poor few people who can't download hundreds of GB's without any shaping while we have to pay for them to do so and use the service reasonably. You've got to be kidding.

Yes - soon all those using download managers for unattended downloads will be nailed.

The MWeb rep already answered this. They can easily, but chose not to because VPN is legitimately used by many users for work etc, which they have no problem with. It's just people also doing all their P2P downloading knowing that they bypass all shaping and then pull 500GB with it. Surely you agree this is unreasonable?

So why can't people using VPNs just not download massive amounts unshaped through their VPN, even simpler.

There's difference between using a VPN for work and using one of these 'services' to bypass the rules. The same way rapidshare, astraweb, etc have a IP addresss/web addresss, so do these non-work, intended to beat shaping VPN servers.

Its a means of protecting the larger user base, in the case that there is no network congestion the throttling policy can fall off until such time as the network becomes congested, its just a matter of implementation. A dynamic throttling system is also a possibility for those that are within the 20% .
 
You know, WRT network usage and how it slows other users down, not once at any time of the day have I experenced slower than 4meg speeds on multithread downloads (No VPN :) ). This tells me that MWEB are within capasity, and I hardly belive they have a single few users that impact the network. I think there are some users that mess up there proffit margins only. I dont think its fair that some claim a select few are destroying it for the rest.

I have a major issue with the way mweb shapes, becase we have all seen that it is not as "load based" as they let on. You can clearly see the way your graphs change as it gets into the early hours of the morning. If I was able to get what i wanted without VPN, sure, I would, but the fact is that they have pushed it past the point of being fun...

There is a lot of focus on us that have used VPN's. What about a seedbox, one that you get your files over HTTP? Effectivly im downloading a file that was intended for the torrent network via http. Is this not in violation of the AUP?

The fact is, WE DONT KNOW. All we have asked on MBB is to have some decent answers. As you have seen I have even asked the Abuse Department DIRECTLY. Surly they are in the best seat to provide us with guidlines?

Im very tempted to have someone on MWEB download via HTTP 24/7 and see how long it lasts... Like I said, my first month was over 800gigs in total, why not start calling me then? Oh, thats right, because they wanted to spread the word about how great they are, build the customer base up nice and high, trust our recomendations then start whistling a new tune.

Im not saying what I did was right, but the way this has been handled is SHOCKING.

Shaping ensures exactly that, it is not throttling but traffic priority. There is no need to throttle users who took advantage of other times the network was uncongested, it's a fair pool and people will have equal access to it.
 
Wow, that is a rather large middle finger being provided by mweb to mrudling. Shocking customer service imo. That is deplorable...

Enforcing their own T&C so that the other 99.99% of their customer base can use the accounts THEY paid for is bad? Um, no. It's what is expected of an ISP.
 
I'm not - I see their answer, even see that it has elements of being correct. What I do see is a really ****ty attitude towards a customer who seemed to be doing his level best to learn how to comply with the AUP. Since it's changeable at all times, I presume you'd be happy with the following conversation:

Lancelot: Why have I been cut off? I've only done 5gb this month!
MWEB: STFU.
Lancelot: That doesn't answer any questions. How can I start complying and not get cut off?
MWEB: We said STFU.

Yes? :D

By intentionally using a VPN/SSH tunnel to download, the user was knowingly bypassing shaping. MWeb does not need to spell it out them.
 
You know the biggest problem here, everyone seems to be forgetting that MWEBS TV add Clearly states you can download as much as you want in any form and sizes.
So dont come with this T&C bull.
If you provide a service you must be able to cater the customers needs.

T&C always apply. Hire a car. Get a cell contract. Whatever. There are always T&C. Whether you read them is up to you. The account is uncapped when used within the T&C.
