I am sure it will be argued that Minister > Acting so it overrides 98

Beyond that, the wording doesn't allow for "Acting" so I would hazard a guess that legally he actually has to replace Mchunu and appoint Firoz.

I have a feeling much of his "fix" is going to unravel legally in the next week or two as it gets unpacked.

Either that, or allocate police to another minister in the Cabinet.

Well, the wording doesnt disallow him making an acting appointment. I'm NAL though but if I was I'd argue that acting or not is the same.
 
Dont know why he had to even appoint an acting . Werent there 2 deputies allready ?
WIll watch with interest to see how the legality of what he did works out
ANC is not known for following the constitution or law

I dont see anything in law that allows an "acting minister" like there are clauses to allow an acting president

No, the wording doesn't give him the room to appoint an acting minister, and from my reading he can only delegate the powers to another member of cabinet.

The wording says "may" not "must". He's appointing an extra minister not in terms of the section in dispute but as per his usual powers to hire and fire as he wishes. This will pass.

Yes it says may.. As in he can do that.

It's not an optional list but you do you.

It will pass, but I do think this will be challenged in court and squirrel will lose.
