Tis Stinky WinkyIs that Tinky Winky or Po at the front?
You cannot have two ministers running 1 ministry. The wording says "may" not "must". He's appointing an extra minister not in terms of the section in dispute but as per his usual powers to hire and fire as he wishes. This will pass.
Where in the constitution does it say he can't have two ministers? Not that that's what has happened but I'm curious where you get that. Dazzle meYou cannot have two ministers running 1 ministry.
If a minister is unable to then the functions can be passed to an existing cabinet member as per the constitution.
You cannot use the argument that it is not written in the constitution therefore can be done. That is unconstitutional
Chapter 5 section 98. Read for meaning.Where in the constitution does it say he can't have two ministers? Not that that's what has happened but I'm curious where you get that. Dazzle me![]()
What words there prohibit him from appointing extra ministers? I remain undazzled, sadly.Chapter 5 section 98. Read for meaning.
OK.. You win. What words there prohibit him from appointing extra ministers?

Also, Ch 5, Section 91.3.What words there prohibit him from appointing extra ministers? I remain undazzled, sadly.
Ah — thank you for the clarification. You're asking:
Is it constitutional for the President to appoint someone who is not already a Cabinet member (i.e., not already appointed as a Minister under section 91 or Deputy Minister under 93) as an "acting minister"?
And the short, firm answer is:
No. That would be unconstitutional.
A note on this, there needs to be a constitutional amendment on a max number of ministers (Ministers + Deputy Ministers). Also, Ch 5, Section 91.3.
A court ruling would set a precedent.
Coming to extra ministers... There is no upper limit. 91.3 unironically says "LMAO, JUST APPOINT UNLIMITED MINISTERS".

Also it would be an interest ruling cover having 2 ministers sharing the same responsibilities and what that does for legislated accountability and performance. Also, Ch 5, Section 91.3.

Without access to the trough senzo needs the salary to make ends meet you know.On this entire schlep with "acting ministers". If Ramaphosa simply fired Mchunu and subbed in Cachalia or suspended Mchunu properly and moved his powers to someone else in Cabinet temporarily, everything would be above board.
It's kinda funny that one of the lead negotiators for the Constitution is acting unconstitutionally.
Something something ANC LIVES, ANC LEADS...Without access to the trough senzo needs the salary to make ends meet you know.
That might be Vinnies best wheel spinning tweet in while.
Lol, using PAIA is an encroachment. Keep in mind, they "consult". These are the same okes who want a "dialogue"...
I think this is a classic case of Rama being too scared to properly take action against his own that he'd rather act unconstitutionally.Without access to the trough senzo needs the salary to make ends meet you know.
Also when it goes sideways he can go 'see, it wasn't me.. Was the evil DA and their court cases' so people can ree on social mediaI think this is a classic case of Rama being too scared to properly take action against his own that he'd rather act unconstitutionally.
