You cannot have two ministers running 1 ministry.
If a minister is unable to then the functions can be passed to an existing cabinet member as per the constitution.

You cannot use the argument that it is not written in the constitution therefore can be done. That is unconstitutional

Where in the constitution does it say he can't have two ministers? Not that that's what has happened but I'm curious where you get that. Dazzle me🤔

A court ruling would set a precedent.

Coming to extra ministers... There is no upper limit. 91.3 unironically says "LMAO, JUST APPOINT UNLIMITED MINISTERS".

A note on this, there needs to be a constitutional amendment on a max number of ministers (Ministers + Deputy Ministers).

Also it would be an interest ruling cover having 2 ministers sharing the same responsibilities and what that does for legislated accountability and performance.
 
On this entire schlep with "acting ministers". If Ramaphosa simply fired Mchunu and subbed in Cachalia or suspended Mchunu properly and moved his powers to someone else in Cabinet temporarily, everything would be above board.

It's kinda funny that one of the lead negotiators for the Constitution is acting unconstitutionally.
