Surname changed without consent

Could you give me more information on this

In order to change your name in South Africa, you will have to get in touch with your nearest Home Affairs Office. From the office, you will have to pick up three forms, the BI-196 for change of surname of majors, BI-85 for application for alteration of forename and BI-9 for Application for identity document. All these forms are available at any regional or district office of the Department of Home Affairs. But due to certain specifications and requirements regarding the processing of these forms, you may not be able to download them for use as an application or registration form.
Once you complete the three forms, you have to submit them along with two photographs for the issuing of a new ID book as well as an identity document that bears the applicants current name (s) and surname.

If you are applying for a change in surname, you have to give sufficient reasons for the same in writing.

  • The natural father's written consent, unless waived by a competent court, is a statutory requirement in the case where the child was born in wedlock.
  • The mothers husband, whose surname the child is to assume, must also give his written consent to the assumption.
  • Both the natural parents written consent is required as well as a good and sufficient reason, in writing, for the change.
  • Copy of identity document (I D)
  • Proof of residential/Postal address
  • Divorce decree, (if applicable)
  • Fathers consent (if alive) or copy of death certificate (if deceased)
  • Stepfathers consent (if applicable)
  • Proof of marriage (if applicable)
  • Proof of guardianship (if applicable)
  • Bring affidavit from the stepfather to assume his surname and marriage certificate. (if applicable)
 
For your surname to have been changed you needed to have specially handed in the paperwork to do so and followed a process.

It doesn't just happen by magic because someone else decided to do so.

You don't get to choose NOT to do it. You actively have to go and do it with it not changing being the default.

So your original post makes no sense.

Well this is what happened. I didn't request that my name be changed to my married surname and when trying to apply for a jet account online I discovered this. I know it can't just happen so someone has been fiddling where they shouldn't.
Check on the thread history. It happened to someone else here too.
 
I'm sure they use the surname on your ID when you apply for a driver's so the licence will be in the name in your ID book. Speaking of which, if your ID book has your maiden name where is it that your surname was changed to your married one. You should be careful as bwana says and check identify theft. Could also be that HA are suspicious of your marriage and are viewing it as a marriage of convenience What with two other attempted marriages on your name.
But even if that's the case, who gave them the right to change it!
 
How do you know it was changed? Based on what exactly?
I applied online for a jet account and I got an error message stating my details do not match up with home affairs. I then called home affairs and checked with them. They confirmed that the surname is changed.
 
Nobody gives them the "right". They just do it, because they are thick, lazy and useless

My married daughter is in the same boat as you, but she is still happily married to her husband and HA decided, without asking, to change her last name to that of her husband.

Her (SA) passport shows her maiden name, her new ID shows her married name and her British passport shows her maiden name

She does not intend to do anything about it
 
Same thing happened to my wife she elected to keep her surname but home affairs changed it to mine without her knowledge. She went in told them where to get off... my wife can be very... how can I put this... ... ... persuasive
They changed it back on the spot. For free btw. For their own sake i'm glad they didn't put up a fight.
 
My sister went to DHA a few weeks ago and explained that she wanted to change her surname back. The official changed it back on the spot for free too. Maybe you just were dealing with people with a god-complex. It happens far too often.

Yes I think so. It's home affairs cbd so that's probably why!!

What reason did your sister give as to why she wanted to change it?

Same happened to my wife. This is actually a broader issue because DHA seems to assume ALL women must have their surnames changed on marriage regardless of what option you select
