Every rapist more than likely does get similar background scrutiny from defense teams.... This one just happens to be in the public domain of sorts.

It will more than likely have zero bearing on the sentence he gets given.

Nobody was discussing mitigation of sentence here, on the contrary, fair sentencing should be good for the perp and the victim... and any potential future offenders. If it's life in prison, then that's it.

It shouldn't matter if it's a girl or a boy and more so it should be possible for them to do something as simple as going to the toilet by themselves without having to worry about external factors.

The perpetrator is the rapist.

The part that makes it sad is that the parents weren't vigilant enough to protect her from that rapist, but it still in no way makes it their fault.

Heard about this on the way home yesterday. What bothers me is why didn't the eyewitness say something? If you see something dodgy then speak up?

What the eye witness saw, only became suspicious AFTER it became known that a crime was committed. A man going to the toilet twice at a bar is not unusual. At that stage he began to piece together how the man's behaviour lead to the crime.

This thread (and the social media) frenzy is about finding the current suspect guilty before the case is proven.
My point is the parents are at fault immediately because of their negligence and lack of vigilance.
The rape still has to be proved by evidence presented. Then one can start to talk about there being a perpetrator. And only then can the process start to prove that the current suspect is the perpetrator!

Right now a number of legal experts are saying that the social media frenzy has created a situation where, if the rape is found to have taken place, and a suspect is found, that he could get off regardless of his guilt or not, just because the whole process has been compromised.
Surely none of us want to see that happen?
And of course it is disgusting that our society has degenerated to a point where no one can even go to a toilet in a restaurant safely.

Use economics:
Cost of keeping him anonymous as prescribed by the law and referring to him as the alleged rapist: R0 if he is innocent or guilty.

Cost of exposing the identity of him, his family and calling him a rapist: R0 if he is guilty or a legal case of defamation if he is innocent.

There is nothing gained from using the latter vs the former.

The defence will not be bringing a bail application today. The State is asking that the accused hands over his cellphone for the investigation. du Plessis for the accused says that they will not be helping the investigation by handing over the cell phone, as it amounts to self incrimination
