I think most people want to be honest (or so my wife keeps telling me) but if the suppliers price the product out of the market they're setting themselves up for circumvention. Legally, that would be importing from other countries, or illegally, pirating.

People are willing to pay a huge price for convenience.

I think most people would buy certain things instead of stealing them if it were more convenient to do so.

But power-hungy governments with their stuffed up finance laws; along with a host of other factors, do not make it convenient for people to get some things that they would quite happily purchase legitamitely otherwise.
 
well if the person walks around with the cellphone sticking out and basically saying to everyone here is a phone then whats the problem?

the point is not stealing.........if people advertise these products openingly then how can it be stealing?

stealing is something that you do without the other persons knowledge,downloading music of a website that has openinly allowed to let people take the music isnt classed as stealing is it? even if the people who created the product know about it?

so if i listen the radio and new song comes on is that stealing? the radio station played the song for everyone to listen too and do what they want with yes? so if i tape that song how is that stealing when the it was allowed in the first place to aired too everyone !

IMO stealing is wrong even if there is temptation right in front of you based on ignorance or distraction from the victim(s).

as for the radio comments, you may record anything for your OWN personal use as long as you dont make a profit whilst distributing it.

you can read about those laws on any SABC or radio station website.

now i will have to be wary not to show off my cellphone in public in case you are around... :p

Stealing is the act of taking something that is not yours without the owners consent. If I leave my cellphone in a bathroom in a mall, I may be a twit, but the phone still belongs to me, no matter who finds it.

If I place a song for download on my site without the consent of the copywrite holder, that's theft (see youtube's current negotiations with distributors)

technically you don't own the information you hear on the radio, the shows remain the property of the broadcaster. Taping for "timeshifting" or your own use is still fair use, but the second you distribute that to someone else that may have had to pay for that content, that's theft, although a rather grey area.

Bwana I totally agree on the Greed thing. That's why I kinda believe DRM done right could actually be a benefit to the consumer. (I think the zune is sort of getting there, but still a long way off)

Basically, I don't buy a media format copy of an item, I buy a quality dependant medialess license for a product. ie I buy a Movie at 480p and am allowed to play that on any device I choose, whether it be my portable, my home theatre, whatever. Downgrading being free, but upgrading to higher quality would be a slight fee. The zune bit being the media sharing, if I want to show it to a friend, they can borrow it for a limit time / lower quality etc.

Unlike physical media ownership if I lose a disk I still retain ownership over what I've purchased and can redownload it for free. The price I pay in store would be for the media and the license, you could buy just the license for less online.
 
I'm sitting here right now in the midst of encoding my dvd collection onto hard drive (a must if you have young kids) knowing full well that I'm committing what is essentially a crime in many lands even though I own the dvd.

I agree with you here, my kids destroy DVD's all the time so copying them onto the PC and then rewriting them afterwards should not be illegal. I am not giving it to anyone else I already paid for it...

If the artist has allowed the music to be downloaded for free then it's not stealing, if they haven't and some scumbag is doing it without their permission then it is

The difference is the radio station get money for the ads between the music, so if you were not listening to the station when you recorded the song it is theft as you have taken money from the station and therefore the artist.
 
i think alot of you guys are getting confused with this law

personally this law is not aimed at public sector its more towards other business that are in direct competition with a company and or its product that they have created,Piracy as you guys call it is a word created for when a product is copied by another company for 3rd party use is it not?

I would have full right to deprive the world of something I invented. That is where we will never agree.

Gavin, please, grasp the concept of the difference between theory and practical example, because the heart of the wider debate is about mankind's reliance on theories of information ownership that are no longer appropriate, no longer workable, or, at the very least, entirely inadequate in the context of a networked society.

Through insinuation, you take a practical example concerning AIDS/Mercs/etc, assess what I/others would do, form blanket theory, then want to use that blanket theory to predict what I/others would do given another practical example. Along with others, I'm saying "it's not that simple".

If I invented it I control it and I decide what happens with it. If I decided to give it away then I could and if I decided not to then I wouldn't.

Flawed blanket theory. Appropriate to apply in some cases, inappropriate in other cases. To illustrate- What if you had invented the wheel?

Piracy is just another form of distribution, if companies are going to persist in not embracing new distribution channels and trying to shut them down - they just going to lose - if they looked at how the market wants its bytes - ie what the customer wants to pay and how they want to receive their purchase - they would shut up embrace the tech and carry on growing their bottom line.

But alas they interested in protecting exorbitant prices for short term gain - i have little or no sympathy for these companies
