Someone is a criminal once they are prosecuted, until then they are presumed to be innocent. Or, should be in any case.

If you are only suspected of criminal activity the police will still come and arrest you and you can easily spend a night in jail or more before your trial. Should they now start taking that persons kids with for a night in jail? Because that's how stupid the argument is that kids shouldn't be separated.
