VANS can self provide

OK, so injecting a little bit of reality into our euphoria here. We can almost certainly expect a Constitutional Court Appeal, and ICASA and the DOC are going to turn this into an issue of governmental control (for the protection of the masses) versus unrestricted competition (to the benefit of the masses). They are going to tell the ConCourt that it will be like the unregulated Wild West and the poor public will be taken advantage of, and standards will erode, etc. etc. Will Altech have the backbone and financial clout to take it all the way?

Yep 100% agree....I have seen alot of VANS at work......quality standards will erode. Have you seen in the UK and USA where one pole has 50 or so aerial wires from it...expect the same here with this legislation.
 
It would be interesting to see the grounds for appeal. Basically, the judgement is fairly clear that the technicality of the law allows "Vans to self-provide", even if this was not the intention, and thus under the ECA licence conversion process, all converted licences must also confer this right.

I don't know that a legal battle would work out so well for ICASA or DoC. It would seem much more effective for them to legislate their way out of the hole by ammending the act.

While we can celebrate the decision, a small victory in a lost war, none of us should forget where the real power is vested.
 
Hopefully with Ivy leaving office (and despite Lyndall 'Tsunami' getting a contract renewal hope she gets booted as well) and most of the ICASA high ups probably getting the uitskop after the next elections they won't have the impetus to take legislative action.
 
the HUGE problem with amending the Act is that we are talking about the telecommunications act - which was repealed on 19 July 2006...

how you would go about unrepealing the act and then amending it i am not quite sure...very much doubt it can be done

Don't really care if it's bad for NeoTel, it could be very good for us, that is all that matters. Maybe now that sports jacket will be donned, and some actions play worked out.

I love the smell of competition in the afternoon :p
