Will Madonsela release 'state capture' report?

I think van Rooyen's interdict is going to be heard at 10 this morning, if it's not granted, she will release the report.

What's the legal standing on this?

An interdict means you can't carry on with what you were going to do. But if it's not been granted yet, how does it affect her? Otherwise a "notice to interdict" is pretty much an interdict already.

According to the link posted by Yorkie in this thread, an intention to interdict is not an interdict. Hence I think the van Rooyen application will decide if it's published

A person can apply for an interim interdict which can be granted before the formal interdict goes to court. However there are quite stringent requirements for that and I haven't seen that wording anywhere in the news, just the notice which has NO PREVENTITIVE binding.

Just my 2c from research.

A lawyer on 702 this morning said there is nothing stopping her from releasing the report today.

A person can apply for an interim interdict which can be granted before the formal interdict goes to court. However there are quite stringent requirements for that and I haven't seen that wording anywhere in the news, just the notice which has NO PREVENTITIVE binding.

According to some sources he is applying for an urgent interdict @ 10am this morning to stop her. If granted, there is no need to wait until tuesday as she will be blocked but a number of legal folks I know say they doubt a judge/mag will grant it.

The judge / mag who will grant this will have to have huge iron balls, because we as public will just put him / her in the Zuma box.
 
Report won't be released, PP got a legal advise from the lawyers not to continue with the release pending the interdict.
 
Problem is the info would be seen as compromised and would probably not be worth much and dismissed.

Not nessasarily, could be somebody else will use it to go forward and base another impeachment vote on it.....

These interdict don't mean much in the day and age of the internet,

Once it's been released and on the net, no nation on earth can censor it.....
 
Pending the interdict, which means 10am so it doesn't change much anyway !
