I got that from recruiters when trying to get a new contract, and I confirmed that with my former colleagues who are still there.

If you read my OP, you'll see that I'm asking for input from other sources and from people aware of policies at other places.

I'm not interested in arguing about BEE, I'm just interested in getting a new job.

And because you get them in on scarce skills they don't get included in the head count as you just claim you can't get the skill in South Africa. That way if they decide not to become a permanent resident you will still benefit seeing you don't need to add them as a negative offset to weaken your scorecard.
 
Stop looking for work in SA. Let the black people sort themselves out. You should stand up for yourself, do your own thing, make your own money. Try to get it offshore. Take the future one day at a time.

No, that's not how it works. Not any random black person counts as BEE. As a foreigner you need to have became a citizen before 27 April 1994 or after 26 April 1994 if you were entitled to citizenship before that but precluded by apartheid policies.

Perhaps more people here need to read the employment equity act before thinking about hare-brained schemes.

Dont think this will apply. You need to be SA CItizen born before 1994 to qualify for BEE.

None of these laws apply.

Atul Gupta came to South Africa in 1993. He only became a citizen in 2002. All his brothers only came after him. Yet, they are the biggest beneficiary of BEE in SA.

So much for these laws. It is all about money and colour of your skin if you want to benefit.

While possibly true, reporting to department of labour only specifies race and gender, I've never seen a BEE report get technical about origin.

They do BEE verification of employees from time to time. We've had it done this year.

All the forms I have seen and I have to personally sign are simple. Questions are. Are you an SA citiizen? What is your ethnicity? Not where were you born. This happens every 6 months at my company. The foreigners who got citizenship recently gets included in the scorecard because simply put the forms don't cater for your question of before or after 1994.

The law was only written to confuse people. It means nothing. It is not being enforced. Only certain people can benefit from BEE. Does not matter when you came to the country, whether you were affected by apartheid or not.
 
Interesting, recruiters just called me 20 minutes ago about a contract position in old mutual. Race never came up once in the discussion and the dude on the other end wasn't white.

BS. Post the screenshot of the BEE form you are filling in. Most companies compel employees to complete and sign these forms every year and I haven't seen this clause before.

The more I look at it, I think this law only counts for white-owned companies.

Yip, but I had some huge guns in my arsenal (several execs) and a niche skillset that simply cannot be bought on the current market - the skills just aren't available. I'm hardly the norm.

You are of course assuming recruiters even know what the company wants. I doubt recruiters ever turn down a candidate that qualifies on merit , they will send it along and let the company do the turning down. They are far more likely to send you to an actual interview where upon arrival you will realize this is 110% wrong, as opposed to advising you it might be wrong. Recruiters don't get money from you not going...
 
Why is it that I hear whites crying foul all the time, but I never seem to have a problem getting a job. Sheesh, I am just a regular ol PM
