Afrihost/OpenWeb ADSL class-action lawsuit

You'll need to brush up a bit on the law.

It's not proved until a court so finds. Until then it is merely alleged. The form commonly used is "I/we aver that...", etc.

I'm using layman's terms. This is not a legal forum after all.
 
I agree with you mickey, but he clearly has an agenda. He clearly has a vested interest in not seeing this progress further. He doesn't have to agree with AH being bad, just that he has had a bad experience with OW should be enough for him to join the cause but he chooses to fight it.

I have no particular loyalty to either ISP and I have no problem with you trying a class action lawsuit.

Whether you are in the right or not, I don't think you would win such a case in SA at the moment (let alone even get one off the ground).
And for that reason I don't think you should waste your time or money.
Think of me as trying to save you the hassle and loss. :)
 
Precedent is as much a layman's term as it is a legal one. A president is someone who presides.

Get over yourself, I know the difference. If you need to pick on one spelling mistake to make your point, you have a very weak argument.

Vested interest: a personal reason for involvement in an undertaking or situation, especially an expectation of financial or other gain.

What do you think it is that I don't understand? I said that unless he is being PAID, then he has no vested interest.

The global framework for class action sets president for SA courts. It's actually written in the law.

Speaking of precedents... Have you checked if any type of legal action has been instituted previously?

In terms of jurisdiction have you approached ICASA yet?

If your current provider is crappy, get another. It's just not worth fretting so hectically over such trivial things.

Do you seriously think for one second that lawsuits can force better service and "improve" things? If so, you're deeply mistaken.

By all means sue to recover losses in consequence of contract beach. But the type of action you propose makes Don Quixote look sane.

Gary's suggestion will save you money and time.

You clearly don't understand the concept of "time is money". I have been through a dozen ISPs and don't have time to try a dozen more every time they decide not to honor their side of the deal.

The reason I am willing to put the time into a lawsuit is because I believe in making a difference in SA. I am for increased rate of development and improved access to information. Taking on corrupt corporations will only make SA stronger.

It will force better service and improve things. When precedent is set and companies are afraid of legal action, they tend to honor their contracts.

That's not the way the world works. Fear of lawsuits hasn't improved a single service or company in the history of the world.
