Cape Town: David Forbes murder case

Not going to work depending at when he was injured. If he followed him for revenge after the effect he is in serious trouble whether it was justified or not.

Massive difference between murder and Culpable Homicide. If he was stabbed and he willingly shot the other dude worst case it's culpable homicide and he might even get a suspended sentence. But all this is just thumb sucking now, no one has any details to this what so ever.
 
This guy having a casual smoke and relaxing while waiting for the police doesn't sit well with me. Is this a familiar situation for him? Why would he react like he just stomped a bug?
If he had just stomped a bug he probably wouldn't need a cigarette and drink to calm himself.

All I'm saying is the witnesses couldn't believe that this guy just killed someone based on his actions afterwards. It would also bother me that the calmest guy after a fatal shooting is the killer.
The witnesses themselves are in all likelihood in no position to calmly observe and report the details of his behaviour. Who can truly say the guy was calm?

Sure but the SA saga are just so much prominent. Go look at the SA murder rate and violent crime stats compared to the rest of the world. ;)

Very true. I was watching 'Bowling for Columbine' last night and they quoted the number of people killed by guns in places like Canada and Australia and the US ... doesn't even come close to where we are. I believe Mitchell's Plain is called the murder capital of the world.
The worst places in the US come very close to matching the murder rate in South Africa. Yes, the murder rate on the Cape Flats is very high - there's a gang war going on - but it is also an example of how the murder rate in one location can skew the statistics.
 
Looks that way. Beginning with the fact that he stuck around after the shooting and now they're assessing his injuries yeah self defence.

How is he going to plead self-defence if he shot the victim in the seat of the car? He kind of had a height advantage over the victim and there wasn't much that the victim could do while seated. Also no info yet on whether they found a weapon in the car, and by the looks of things, the worst it could be at this stage, is a knife. So how do you bring a gun to a knife fight and then plead self-defence after you've shot the bearer of the knife?

So many unanswered questions.

Not too long ago a guy got stabbed to death by a seated Taxi driver. This is all irrelevant. It's all about how the defendant felt in this situation. If he felt this other guy could have stabbed him to death and his life was in danger = Self defence. He shot the seated guy in the stomach. Meaning he was halfway inside the car when it happened. He was not going to shoot him in the stomach if he was standing next to the vehicle. The seated guy could have grabbed hold of him, pulling him into the car with the intention to stab him. He defended the stabs with his one hand, reached fro his firearm with the other and got a shot off.

It's not so hard to draft all these weird scenarios. It's all very likely. We need to wait for more info tbh.

Too much info is missing.We still dont know what happened other than someone is now dead.Could be that the dude in the golf was selling fake tickets and he was confronted in the car, pulled a knife, and then got shot, in which case Forbes wouldnt get murder...

Why is it that everyone is wishing this to be the case? So that they can justify what this man did?

From the bail application hearing, I got that the cut was about 4cm - I'm still trying to fathom how big or how small 4cm is. So a 4cm cut warrants 4 four bullets? Right.

4cm cut on the neck or into the chest can be fatal... Only needed a follow up stab to be deadly, if he was attacked with a knife first before firing then it's self defense in my opinion.

Who says all the shots that were heard, came from the same gun? Why would this guy do something like this publicly, if it was not self defense? Wouldn't he rather hire someone to kill the guy? If he stayed as calm as he did afterwards, do you think an argument would get him so worked up, that he would shoot without thinking about the consequences?

It was on his arm - not even on his wrist . I would hardly call it fatal.

I can understand that you can respond with deadly force when your life is threatened, but the accused had both a height and weight advantage over the deceased. And, the stabbing did certainly not take place on the forecourt because all the eyewitnesses saw was an altercation. Let's just suppose that the deceased DID stab the accuse from his seated position in the car, then how much harm could he really inflict from that position?

Even a stab to the leg can kill a person.

You just offered this theory, so YOU tell me where the second gun was because, to date, no gun, or knife for that matter, was found in the deceased's car.

Maybe he had it all figured out? Maybe he inflicted himself with that wound (thought I'd throw in my own ridiculous theory). Maybe he stuck around so that he could tell the court later that he was co-operative? (He did this in his bail hearing btw). Or maybe he is just a cold-blooded killer, who have done this before but maybe not in public, but staged this in such a way that that the victim might seem like the perpetrator or aggressor.

Heaven knows.
