The wording on MWeb's
T&C page is quite troublesome, especially paragraph 5.6 and 5.10:
5.6 You may not restrict, inhibit or interfere with the ability of any person to access, use or enjoy the Internet or the ADSL Services, or create an unusually large burden on our network, including, without limitation, continuously uploading or downloading streaming video or audio; continuous FTP uploading or downloading, or otherwise generating levels of traffic sufficient to impede others' ability to send or retrieve information, or to use the ADSL Services in an abusive manner in connection with any unlimited packages, options or promotions.
5.6 It's worded quite strongly, effectively eliminating power users.
5.10 You may not use the ADSL Service for unattended automated operation, unless otherwise agreed. You may stay connected as long as you are actively using that connection. You further agree not to use Internet applications for the purpose of simulating network activity to avoid session inactivity disconnection.
It's as if 5.10 was written for dialup users and needs to be removed? The whole point of using ADSL is to have an 'always on' connection!
No unattended operation allowed? Half the things users do online today are done without being in front of their PCs. From download managers to monitoring security webcams at home to automated software updates, etc.
Today software like Skype and other chat messengers do network requests all the time to stay connected anyway, half my add-ons in Firefox do frequent requests to 3rd party servers to check for little updates to ensure those add-ons are functioning as they should; so there are a lot of software out there that are legitimately used which can be regarded as "simulating network activity" on the network.
The wording of 5.10 is therefore completely irrelevant.
It's one thing to for users to hope these terms are not enforced but the reality is that it's legally binding and the wording should rather be changed to comply with the actual services offered otherwise it will scare prospective consumers away. I wouldn't want to sign up with MWeb just to be disconnected because I have software running that once in a while does a network request.
Furthermore there's no need to check if users are trying to stay connected, they're expecting to be connected 24/7 anyway, it's ADSL !
According to 5.10 all users should basically switch off their modems and routers when they leave their homes.
These are only two paragraphs, but the reality is that the T&C page will need an overhaul since it still seems to be outdated. It's one thing to protect MWeb through legalese but when the wording is so draconian that it makes the actual statement irrelevant, then what's the point?
