The only way afaik to do it correctly without it being considered tampering with evidence is to get Apple themselves to unlock the phone.

Surely with a court order they can 'tamper' as much as they like to get it unlocked?

Pistorius could reportedly not remember the four-digit passcode needed to unlock the phone at the time.

I find this very strange. I mean you use that 4 digit code every time you use the phone, how can you suddenly not remember it?
It seems he really doesn't want anyone to see what's on there.

Technically that's still tampering.

As far as I know forensic software can also extract the passcode or brute force it. Then there are also quite a few methods to bypass the passcode without changing anything on the phone.

Or he is sending them on a nice wild goose chase. By the time they get into the phone and realise there is nothing their case is nothing cause of the time wasted on the phone instead of other leads

Our constitution includes protection from self incrimination, so yes, it is valid.
