Software pirate caught in sting operation

Well by selling copyrighted materials you go into a different class as the law portrays as well.

I still do not see how my downloading for personal use is the same as someone downloading for financial gain.

It doesn't matter whether you sell or not. (Think- the recent scapegoat downloaders being sued millions by the music industry)

You are being hypocritical because you wouldn't be able to download your Copyrighted material unless an entity was providing a service to supply it to you in the first place.

Why is this Chinese student deserving of punishment when say Rapidshare and Pirate Bay are making a prety penny selling porn advertising, whilst you 'self justifiably' use their service?

Are you not snapping at the hand that feeds you?

Because you haven't paid the person who owns it. You have acquired a copy of something that belongs to someone else and you have not paid them for it, end of story.

Look, a lot of people on here have pirated, and I agree that we generally get ripped off. So I really don't care if someone pirates or doesn't, in fact I would like nothing more than to see these huge record labels burn.

However don't confuse that with me agreeing with your interpretation of the rights you hold as a DSTV subscriber. Multichoice paid for the right to store and broadcast that intellectual property. You did not. You paid for a service provided by Multichoice. Whether you have DSTV or not does not influence how much money the record or film companies receive. You therefore have no right to download that content without paying the owners of the aforementioned content as all you have done is paid Multichoice for being able to receive their broadcast.

Without putting too a fine a point on it, you have avoided paying the royalty fee the owner requires of anyone who uses their product (in this case, watch the images), and so that royalty fee languishes in your bank account and is available for other purchases whereas it should be languising in the bank account of the property owner. In other words, you sit with a surplus value you would not otherwise have, which is also called profit.

Paying a royalty fee to watch it on DStv does not confer a lifetime right to watch it anywhere on any medium without further payment. If it did, the networks would be paying much higher prices to broadcast the material.

Also, the advertisers on the network are paying a huge amount of money to flight their ads, and this leads to lower subscription costs (which include IP royalties) for you the user. If what you are saying and doing becomes pervasive, the whole economics of broadcasting and advertising changes, with unpredicatable results ... either movie makers get less money and so produce less for cheaper (ie quality goes down) ... the knock-on effects will almost inevitably mean we get even crappier tv, more expensive broadcasting, and lousy software ...

Well i may have only paid dstv but by paying dstv i have contributed to their ability to be able to broadcast such shows, so in fact i think i have every right to download the series and watch it as i have paid dstv who in turn pay the makers of said show.

So i am not agreeing with you okes at all, if i had a pvr decoder and recorded it, how would that be any different? I refuse to sit and watch my fav dstv series via dstv because it wastes my time and i hate adverts. Now i could get a pvr and record the show and skip the adverts, would i also need to pay royalty for that?

Charl Potgieter of legal firm Bowman Gilfillan said the real victims were the unsuspecting students and consumers who purchased the fake goods, expecting a quality product

Who said it wasn't quality? We talkiing about a keygen! All Microsh*t is loosing is a few dollars anyway. It seems lawers don't know anything about technology

Multichoice pays the media companies, you don't, please don't confuse the two. Multichoice does not own that content, it only has the right to braodcast it, not to distribute it. If DSTV has no right to distribute it or save it and take it home, what makes you think you have that right by paying Multichoice?

No, because everything you record on that PVR decoder can never be moved to another medium, therefore you can never actually keep it. The minute you stop your DSTV subscription then "BAM!" away goes the shows you've recorded.

Of course you can keep it, i can keep it on pvr for the next 20 years and my buds can come over and watch it.

I will never unsubscribe from dstv, i would rather eggs and bread everyday than unsubscribe.

So you are saying i can record it on my pvr and keep it for as long as i want but i cannot download it and watch it ad free? Sounds like a bunch of hog wash to me. of course if i have it on pvr i can get it off by using a dvd recorder so i am not understanding why i can use a pvr to record a show but i cannot download and watch a show that i pay for every month via dstv who has in turn paid for the right to broadcast it. I am just broadcasting it to myself ad free :D

And as soon as your illegal content provider gets closed or sent to jail, BAM there goes your ad free soapies.

Which piper are you going to pay killadoobie?

Actually i get my series from a site that does not use torrents, i do not even see much advertising. they will never close a series site.

Firstly they promote the show for people who have not seen it, loads of people actually pay their network a monthly fee to see the series and i have not heard the series sector moaning about piracy.

Please tell us exactly were you angelically acquire your content?

Wouldn't want to get in trouble now.

You seem to misunderstand these sorts of things. How old are you because I really don't understand why this is so hard to comprehend and the only reason I can gather is that perhaps you are too young to understand.

You have no right to do what you have just said in the quote above. No one is debating whether or not you CAN do it, we are debating whether or not you are allowed to based on the fact that you pay for DSTV. The answer still stands, you are not allowed to do it. It does not justify your actions.

Wrong. You don't pay for shows. You pay for access to a broadcast. You haven't paid a single cent for those shows. Multichoice has. Honestly if you can't understand that then I'm not going to bother.

Also you are not broadcasting it to yourself, you are creating a persistent copy of it that you can take away and watch whenever you want and that is what the owners of the content have a problem with. You did not buy the rights to a copy of the content, you only have a right to watch DSTV's broadcast stream. If you want the right to watch it whenever you want then pay for the damn song or series.

If you want to pirate then go ahead, I really don't mind. However don't bring rubbish excuses like "I pay for DSTV therefore I can pirate". That is not a justification. Don't be a moron. Rather just be content that you pirate and don't really care about who owns it or whether or not you've paid for it. I can understand it from that perspective. Your current views lacks logic.

I never made the excuse, i do not have to excuse piracy. I said people who download tv series do not need to worry if they have dstv, i never once used it as an excuse for piracy. So you should maybe realize that and then we can move on.

If i have not paid a single cent for those shows, tell me what happens to the 6k a year i give multichoice? what am i paying 6k a year for then? The broadcast of shows correct? So how can you say i am not paying for the shows, what is happening to my 6k a year then? Without multichoice's subscribers paying their money how would they purchase the shows?

I have not made excuses for piracy nor will i ever i just commented on peter's comment about series and piracy and i said i do not think you can be considered a pirate if you have dstv and download the shows they show as you have access to them and can record them and watch them.

You still have not answered my question though, dstv let me record the shows so why can i not download them? What is the difference if i watch the shows via pvr or via avi's that i download?

Dude it is my job to know what should be shut down and what should not be shut down.

My point was never about putting it on dvd, i was told you cannot get the media off the pvr so pvr is fine but avi's are not, i just pointed out you can easily get the media off a pvr so i do not uinderstand why we can save the files on our pvr but cannot download the avi's.

It seems flawed to me.

portch is saying you cannot watch the series on any other media but the broadcast because we only pay for the broadcast but why are we allowed to record it on pvr if that is the case?

bollocks

you are pirating

If i have not paid a single cent for those shows...
you are avoiding the point

I have not made excuses for piracy nor will i ever..
hypocrite, you are doing it now.

downloading is considered theft, we didn't make up the laws.

Dude it is my job to know what should be shut down and what should not be shut down.
It is. Ask yourself this hypothetical question:
I give you a hard drive with all of your favourite programs, software, movies and music. Do you take it or leave it?
