When can you legally cancel a contract?

I have issues in my area where the Vodacom network will begin switching between 3G and EDGE every minute or so. Every time it switches data disconnects. This has been ongoing since last year and Vodacom's network department will not return my calls as promised by their customer services. I understand voice customers get disconnected when this happens from the few people I spoke to in my area.

I now need to see if I can legally cancel these contracts - I have two contracts with them.
 
They don't guarantee any sort of 3G service since it's best-effort. There is a reason why they give you a coverage map on their website.
You can cancel your contract at any time, but you are liable for the cancellation penalty, which would be covering the remainder of your contract.

I know they don't guarantee 3G but there needs to be a connection. When it jumps around it's useless because it's not that it goes and sits on EDGE. It will go EDGE for a minute then 3G full signal, then 3G one bar, then EDGE full signal. Every time there's strength change I get disconnected no matter what. It is not limited to my contract SIM as I see it on my iPad too.

Does it do the same thing if you force the modem onto "3G Only" mode?

My router (which is what I use to connect) is set to 3G only, but that's besides the point because the problem is network related.
