Afrihost/OpenWeb ADSL class-action lawsuit

How many dollah u want from each person in your class action law suit? Or are you hoping to go pro bono?
 
What was the outcome of that? I'm one the naysayers simply because I believe this is a waste of time that will go nowhere. Now I'm no lawyer, so if you obtained legal counsel that says otherwise then I'll be keen to hear about that.

Basically what many others have said is true, it's difficult to prove its deliberate dishonesty; unless we have enough consumers with correspondence that shows dishonesty.

How many is enough depends on the quality of the evidence they bring.

Other than that, the law is on our side wrt false advertising, not honoring a contract, etc. The FUP and 'best effort' clause will not hold much weight in court as it will be on the ISP to prove the average consumer was abusing the network and that they were indeed providing the best service possible. Neither argument will stand given the speed data captured by the users will put forward.

Not really interested in your random thoughts and opinions. What does an actual lawyer say? You said you were in the process of obtaining legal counsel, what did the lawyer say?

This is irrelevant. Telkom may be the lowest common denominator, but these ISPs are also common denominators, and considering the issues revolve mostly around them, they are most likely the issue.

Besides, SA law states that the entity we purchase the service from is directly liable, regardless of where they get their service from. Exactly the same as when users could sue their cellular providers for the blackberry outage some time ago.

I'm afraid that it seems all the naysayers are successfully discouraging consumers from standing up. Class-action is a numbers game, if we don't get enough people involved, the ISPs are just gonna keep getting away with it.

Which country do you live in? It takes months to get a court date. Then you got to go through a pre trial, etc. You clearly have no experience with the legal system.

I'm not going to file for a court date until I have enough support, that's just a waste of my time and resources. If and when I get the backing from other users, only then can we progress.
 
Wonder when Wewantspeed realised that joining a forum and fighting with everyone from the word go/insulting those that don't agree with his opinion is the way to win friends and influence people?

He obviously is quite a cool cat, very refreshing, can see he has the head on him to negotiate the minefield that taking on a a large well financed ISP will entail.

Cant compare the two really - MWEB wins by a mile, despite them not being my favorites. Give credit where its due.

Either way, the OP will need alot more than threats and hot air, and I somehow dont think he is getting the support he expected.

Oh well, we all have our own missions, pet hates and points of view, so good luck to him.
But it does make for an entertaining thread :D
