As for a data capturer... I've done a bit of data capturing work in my time Although I'm guessing you'd want one located in JHB? :D

@ sn3rd - I saw that... Was mildly hoping your notebook was less than R7,000 :( I think your only course otherwise is Magistrate's Courts - Claims for less than R100K... I'm unfortunately uncertain of the costs involved there...

My prices scare you :confused: ... which pricing? I'm usually in the same price category as Sybaritic and Prophecy give or take 2% ... although I know sometimes they get specials.
I would be having many more specials if I just had the time to sit and create and organise with suppliers ... but I just don't ... which is why I'm hoping to hire someone early next year, as well as a data capturer to do the nitty gritty stuff :p.

You shoulda e-mailed me ... or better yet, smsed ;) /chinese accent on/ I give you best price. You save 50c. Be a man, do the right thing /chinese accent off/... I woulda checked stock for you :p ... the Leadteks are the cheapest Geforces I've seen to date ... strange coming from Rectron :p

If it escalates further ... let me know ... I've still got my commercial law books from 1st year. I can help you out. They are in breach of contract as the initial terms of agreement of sale were falsified, and its not in their pricelist (that I know of) therefore no E & OE. You seek ratification as well as a claim for damages on time lost and unnecesary expenses incurred.

Throw some legal terms at them such as:
Obviously there has been a breach of contract on your side by not supplying me with the correct laptop. This has led to a situation of "Positive Malperformance" as you have delivered a performance, however it is not the correct performance as per the original agreement. I now feel that due to your conduct, it has reached a situation where I must take this to court. Please understand that I will seek the following at the trial:
-Claim for specific performance of the contract - and I will ensure that the court orders you to purchase the correct laptop and give it to me as according to our initial contractual agreement.
-I will also lay a claim for damages, based on my average hourly salary (Based on monthly wage divided by 40 working hours) and the number of hours I have spent trying to get this sorted out. Also, there will be a claim for my phone bill as well as driving expenses and interest on the money you have kept in your account.
So the way I see it, you have 3 options ... you either give my money back right this minute in cash. Or you give me the correct laptop as agreed upon within the next hour. Or we go to court, you end up giving me a refund or the laptop initially agreed upon and you also pay damages and legal fees. The choice is yours.
 
Make sure of the specs 200% beforehand :p

Its just some Divoom XForce-1H's ... nothing to worry about :p ... me, I only buy laptops through Mustek (Toshiba), Axiz (HP, Acer), Rectron (LG, Asus, Sony). Won't buy them through the reseller suppliers :p

The only reason I chose to deal with them was because when I go there, the queues are short. :(

Their short queues still seem to take longer than Rectron or Frontosa though :p

I chose not to deal with Frontosa because of all the negative publicity I've encountered with them. Better safe than sorry, yea?

Problem 99% sorted:

Axiz is accepting the notebook back for full credit. Thus Comstar is passing me full credit. Now for getting cash...
 
Axiz just called me. According to the lady I spoke to, they are able to offer the correct notebook (with correct screen). She said she was sure. I told her that Comstar had said the notebook was unavailable with a BrightView screen, so she said she'd make doubly sure and get the relevant technical people to contact me.

And STILL, Axiz seems to be the light at the end of the tunnel through this whole thing :)
 
Spoken to Aldean (axiz), Savan(axiz) and Richard(Comstar), and the situation is as follows:

Aldean had it wrong: they don't have stock on the 6730s with BrightView. This was confirmed by Savan. I have asked for them to credit Comstar, which they agreed to. Richard has conferred with Amit and has organised a refund as soon as the credit is passed. I have requested EFT, and Richard seems fine with that even though I paid cash (it's just safer for me).
 
Woohoo!!!! *confetti* Seems things are finally going right. Make sure you get them to forward a proof of payment to you juuuuust in case ;)
