Car accident advice

Hi guys

I was involved in a accident 2 years ago. I bumped into a 99 Audi from rear, someone bumped to me as well from rear. It was on N1, and there was a standing still for some reason. The audi was said worthless to repair, so the guy is trying to claim R48000 from me. We are going through pre-trial at the moment. The audi guy is got a lawyer, but I don't.

Both he and I didn't have drivers license and both cars weren't insured.

Any advice on this matter? by the way, I tried to offer him R15000, he didn't want to take it.

This is the reason one has to have at least 3rd party insurance.

Now what do you mean neither of you have licences? As in neither of you have driving licences in your names or you just didn't have the physical license with you?

I'd suggest you also get yourself a lawyer. What about the person who hit you from the rear? Is there a claim possible either from you or him/her?
 
What about the bit of the two of you not having licenses?

Sounds to me like two drug dealers suing each other because they're stealing each others' drugs.

But yeah, lawyer up.
 
Amy I'd use that 15k to get a lawyer and go after the guy who rear-ended you! :D

Both of you need some sense slapped into you.

Edit. Okay so yeah, he can and may sue you, but the court will just nail both of you for being on the road illegally and not reporting an accident.

No sympathy for you sorry. Hope you have learnt your lesson.

In my opinion the best you can do is if they take it to court point out the drivers licence issue to the judge (or just point that out to the guys lawyer now).
 
If he didn't report it to the police station, and you didn't.. then technically he's going to have a tough time with the judge, as are you tbh.

So it seems that the drivers license issue is not an issue in this case, but will be handled separately along with not reporting it.
The other driver can still sue him for the damage to his car, and may win it, assuming that he was not driving negligently.

Point is the audi driver is screwed for not having a license, and amysa2012 is triply screwed. Once for not having a license, twice for not reporting it, and thrice for R48000 (and possibly cost of suit too).
