Are you having a problem as we speak?
has the rules changed for standard uncapped. usually 5pm the gates open but its 7:30pm and im trotting along at 50KB/s.

No, it is always fine before 8am and after 5pm on weekdays. And no problem on weekends.
Is a bit slower than usual here too. Only getting ~200KB/s on NNTP.
It should start calming down tomorrow and Wednesday
Shaping is not 'hammering' anyone. It is managing you according to your contention ratio, priority on the network and how busy the network is at that specific time.
If a Gold client is experiencing very slow speeds, there is more than likely something wrong, and we will need to investigate. However, if the fault is simply torrents that are slow, or NNTP that is slow during peak, then there is not much we can do, as shaping will be applied during peak periods.
What about if your account states 4MB Uncapped, UNSHAPED
Have you actually notified your current 4MB Uncapped, UNSHAPED Clients that they will not be getting the UNSHAPED part they are paying for?!?
My line works perfectly well with an Afrihost capped account during the day. And with anything http my 4MB Gold account is acceptable. Unfortunately, from time to time I require the use of non-http protocols during working hours. And for that the account becomes totally useless. If it was half or third the speed that would be no problem at all. But crippled is just not acceptable.
