HELP: Attorney to collect debt

my mother with good intention lent money to someone who later on refused to pay the debt.
at that time, we were not aware that this person is a manipulative and dishonest lady. turned out that she has burnt some people before, but no one can afford to take legal action against her.

Because she refuses to pay her debt (despite having money), my 71 year old mother suffers financial problem.

I'd really really like to help my mum find justice.

Can anyone recommend a competent lawyer (yet affordable) in Sandton area for this type of case?

I can't answer the question about the lawyer - but why don't a few of you that have been burnt all pay for the lawyer?
 
I can suggest a good company, they're not cheap though. Maybe you can call them and explain the situation and maybe negotiate that they their claim fees from the manipulative and dishonest lady?

My collection techniques would not hold up in court though :o
 
How much is it? Small claims court could sort it out maybe. No Lawyers needed.
 
Dolby, some of the people she burnt do not have 'loan agreement' letter, hence they can't do much.

Waain, I have checked the Small claims court. the debt involved is way bigger than what can be claimed at small claims court.

geriatrix, I have tried 2 laywers, none is willing to take it on a contingency basis (no win no pay). yep, wouldn't mind getting info on recommended law firm.

I am prepared to pay lawyer's fee (I will do whatever I can to teach this girl about 'bad karma')
My problem is, finding a lawyer who is suitable for this type of case. I mean, I don't need a top gun lawyer who deal with big corporate/difficult cases. The debt is R300,000 ...not millions.

R300 000... eina. Why on earth did your mom give her the money without any official agreement on paper?
 
there is an agreement letter for the debt.
my mother is 71 years old, she is a very kind hearted person and loved to help people (though she was being not smart in this case...sorry mum).
the lady who borrowed my mum's money knew this and she basically manipulated my mother. this lady's husband has money, but she told lies to the husband about her debt (and he believes her).
argh, so upset to think about this. I was not around when that happen.

remy, i would like to get the money back for my mum, it's her life saving.
due to the amount, i guess debt collector might not be an option eih? argh, why are lawyers sooo expensive!!!

I also know someone else who was burnt by this lady, the amount is R30,000. there is a written loan agreement. She doesn't really know how to deal with this issue (she's not the type who read and search the net for info).

mmm...I will try to talk her into using a collection agency.... any recommendation for debt collector? (feel free to PM me)

Some dude did something similar to my grandmother.

She just gave him the cash though, there wasn't even a "loan". On top of that, I think it was quite a bit more than R300k...

Despite court orders etc, the money kept disappearing. The family now has to give her "pocket money" for her to buy stuff, as she cannot be trusted with that oke around, who still calls/visits/threatens her.

Again, best of luck getting some of that money back.
 
I am interested in what she actually claimed the money was going to be used for ? And, when did you mom expect it back? All in 1 shot?

I don't mind efforts to recover the money, but Budza is suggesting violence.

An eye for an eye will leave the whole world blind :)

Exactly - and I'm happy for it. I believe you get what you deserve... and I believe if you commit a crime, you should be punished - severely.

If I kill someone's wife, or rape someone's daughter - the punishment should fit the crime - not a measly 5 year jail sentence.

If I steal from someone, MORE should be taken from me... it should actually be a two eyes for an eye. What gives me more rights than the person I have stolen/raped/murdered/etc from.
