If I have read the announcement correctly ...

"1 February 2005 shall be the date from when a person who provides a value added network service (VANS) shall be entitled to cede or assign the right to use, or to sublet or part with control or otherwise dispose of the telecommunications facilities used for the provision of the value added network service."

I can contact IBurst, and draw up a contract where I operate under their Value Added Network Services license.
I purchase their biggest uncapped and highest-bandwidth product, and re-sell their bandwidth to people and its legal. Cool.

or

I contact IBurst and draw up a contract where I operate under their license for zero profit to me or them.
I then join into the existing WISP network and everybody using the WISP signs a WEB-SITE-BASED (HTTPS)(No Costs,No Profit) contract with me. Everyone on the WISP is then legal.

Am I barking up the wrong fire hydrant ?

Thinking .... (Yes it hurts)

IBurst would get the benefit of good publicity because they are supporting the WISP's (Option 2).
I really think that they - or some other VANS would be prepared to do it.

Are WISP's legal ? Isn't establishing a wireless link between 2 properties legally equivalent to running a cable between the two ?
And don't you need a license for that ?

nicroets - Using a VANS license should make it legal.

The more you know - the worse it gets.

I don't want to crospost, but you are all wrong. You can simply
ignore Icasa. Look under the POST : Legal on the Wi-Fi forum for my complete legal argument. It applies to the convergence bill and all the other bills Icasa want's to use to extort money.
