Minister agrees to suspend SNO licensing

Pretoria - Communications minister Ivy Matsepe-Casaburri will not grant a licence to stakeholders in the second network operator (SNO) until at least October 29, pending negotiations with shareholder Nexus Connexion.

Nexus yesterday launched an urgent high court application to stop Matsepe-Casaburri from implementing a decision taken in August that awarded shares to two foreign-led groups, Communitel and Two Consortium, giving them "significant participation" and allowing an unidentified financial investor to control the SNO.

Nexus, which has a 19 percent stake in the SNO, sought an interim order to stop the minister from proceeding with the licensing process, pending the outcome of review proceedings to set aside her decisions regarding the operator.




A settlement was reached when Matsepe-Casaburri agreed not to proceed with the process because of the negotiations with Nexus. The application will go to the high court on October 26 if the matter is not settled.

Review proceedings to set aside earlier decisions regarding the second network operator are still pending.

Nexus chairman Xolisa Memani has accused the minister of overstepping her powers.

Nexus is not an "investor". They have no funds of their own. Thats how BEE usuually works. BEE companies get given shares for being black and then when the share price has risen sufficiently they cash in their shares and bank the profit.

Notice how the "substance" of Nexus' complaint is never reported ... thats not an accident.

This also illustrates how farcical most of the BEE stuff is. The Nexus fatcats are trying to sqeeze out every last drop of money to line their own pockets by threats of legal stalling. Meanwhile the population that they supposedly represent sit without affordable commnications.

I'm sure if you interviewed a Nexus press officer they would wax lyrical about the need for the downtrodden masses to have affordable comms.

Sickening ...

Fundamentally though its the governments fault ... they created the foobar playing field that allowed this situation to arise.

interesting that when all this started the goverment wanted someone big to come in and ruffle the feathers, ock the boat, they wanted a AT&T or a BT, but then they added so many conditions that none of the real big players that could have made a difference wanted to come anymore.

Screw the SNO ppl...from 01 Feb next year, WISPs can simply plug into Transtel/Esitel networks and bypass Telkom nationally. Of course there is still the problem of international access...

If I was a director of once of the companies that are supposed to be part of the SNO, I'd seriously look at scrapping the whole idea and get involved in Wireless/Elec Cable Mesh's. Or - at a minimum, have a strongly worded buy out / sell out / leave clause in the shareholders agreement.

Also - I wish that Transtel / Esitel had the balls to challenge the entire concept of requiring a licence to provide a service that the nation sorely needs. Surely there is a good angle in the constitution:
"Government must make laws that:
prevent pollution and damage to the environment,
promote conservation, and
balance economic, social and environmental development."

[Balance economic, social and environmental development] - this clause alone can be used to force the government to issue a license immediately, or force the government to force Teklom to drop prices and make basic telecoms available to those who don't have it. But - fatcats are fatcats are fatcats are ...

The more you know - the worse it gets.

Telkom, esitel, transtel, sentech, vodacom ... all just fingers on the government hand.

Only truely independant commercial companies could inject life into the rotting corpse that is the ZA telecoms scene.

Of course the gov have specifically created conditions that exclude true commercial investors.

I'm just wondering how relevent the SNO is really going to be, now that restrictions are being lifted. I was excited about the SNO because it was going to create some competition with telkom, but isn't that going to happen anyway now? Or am i wrong?
Also, i wonder who fits the legal bill for BEE companies like Nexus? Them? Joe public?
Its unreal that a company who hasn't invested any cash in the SNO can stall things like this.
