Cape Town student says his life has been “destroyed” after he was arrested last week for “waving away” President Jacob Zuma’s noisy, blue-light convoy.

A “notice of rights” document issued by police shows that Chumani Maxwele, 25, was charged with “Crimen injuria against the president of the RSA”.

Maxwele was jogging on Cape Town’s De Waal Drive just before 6pm last Wednesday when a convoy of six government cars sped past him.

“I waved them away, as if to say ‘hamba’, because of the noise. After that a black BMW X5 pulled up and three guys jumped out, pointing guns at me,” Maxwele told Sowetan.

This was the start of a 24-hour nightmare for Maxwele, who is an active member of the ANC’s Cissie Gool branch in Woodstock, a fact confirmed by his chairperson Vanessa Wood.

“They pushed me into their car and shouted at me that I had disrespected the president. They pulled a bag over my head and drove me to Zuma’s residence,” Maxwele said.

He was transferred first to the Rondebosch police station and then to the Mowbray police station.

Mowbray police accused him of saying that Zuma had seven wives. They claimed he insulted Zuma – and told him “intelligence” agents would deal with him.

The next morning, people whom he believed to be intelligence agents arrived to interrogate him.

“They said they were from a higher office in Pretoria. They asked me my opinion of Zuma. I told them I support Zuma as a disciplined member of the ANC. I didn’t know it was Zuma’s convoy. It could have been Helen Zille’s convoy, but they jumped to this conclusion that I am a Zuma hater,” Maxwele said.

The “agents” also asked Maxwele for his friends’ names and those of the chairpersons of his ANC branch and of his community policing forum.

Maxwele said the agents told him “be careful what you do when a convoy passes because people are sensitive. Don’t touch your head or your waist”.

In the meantime, plain-clothes officers raided his house, going through his personal diaries and notebooks.

Maxwele spent the day in holding cells underneath Wynberg magistrate’s court. Almost 24 hours after his arrest, police arrived and told him to “get out”.

“I didn’t appear before a magistrate. I feel destroyed because this can have a bad impact on my quest for future employment and travelling.”

Maxwele will consult lawyers on what action to take against the police. “That’s my jogging route. What if I see the convoy again? Must I abide by an invisible law?”

Meanwhile, the identity of the agents remains a mystery. National Intelligence Agency spokesperson Fikani Dube said “none of our members were involved”.

Zweli Mnisi, spokesperson for Police Minister Nathi Mthethwa, could not confirm that police intelligence officers were involved.

Constable Monique Hendricks of Mowbray police station confirmed that “the state” had charged Maxwele with “crimen injuria” around “a Zuma matter”.

Absolutely pathetic actions on the part of the police and other idiots involved. I hope this guy gets a really good lawyer.
 
haha,... I don't have to wave at Zuma... he is doing a pretty good job of insulting himself all by himself without my help! :D

But yes... this is shocking and does not bode well for SA. Not surprised though. And yes it does smack of Mad Bob tactics.
 
Yep, sad but true, I expected this coming a long time, reminds me of the Muslim states and in particular a certain murderous African leader. I presume soon just typing what I just did would put me in exactly the same position. We will have to tread lightly in future. Zuma is president now and for ever!

I will bet you anything you want that Zuma wont be president forever.I'll round up a couple lawyers and we can make the bet completely legal.

A bit rich coming from employees of the man who incites people to sing m'shini 'wam. Wonder what they would do you toyi toyi and sang m'shini 'wam when a convoy goes past?

If this is true, then all I can say is that it's not unusal for a banana republic....
 
Maxwele should just have said he was hoping to catch a lift with the president and he used a new hand guesture for flagging down convoys like the zap signs used to stop taxis in their tracks.
 
Isn't the Sowetan a tabloid? This story sounds made up to me.

Yeah then he would be ousted by Cosatu and their cronies and then Malema will take over. So it remains the same If Zuma is not going to be the next Idi Amin clone then Malema will be.

Anyway, why you say so, I would like to know as it was a very close shave on Mbeki! Remember!
 
I said already, zuma is a dictator.

even insult mandala he will not feel angry about that it is because we are in democratic country. When one day, you see your "freedom of speech" have gone away, that means democracy is over.

Crimen injuria is a crime under South African common law, defined to be the act of "unlawfully, intentionally and seriously impairing the dignity of another." [1] Although difficult to precisely define, the crime is used in the prosecution of certain instances of road rage [2], stalking [1], racially offensive language [3] , emotional or psychological abuse [4] and sexual offences against children.[5]

You can also open a case of crimen injuria against somebody else. Unlike a dictatorship where they state have all the might.

In Zim people were also arrested for no apparent reason. Woman were arrested for prostitution, unless they can proof that they were married to the man with them. Eating out of with your wife wasn't that pleasant any more.

Today they arrest people for making "signs" at the president (although the jogger wouldn't know it was the president), tomorrow you get arrested for ...
